What if manufacturers gathered their nicotine from a source other than tobacco? All nightshade family plants have harvestable levels of the alkaloid. The FDAs control over E cigs as a "tobacco product" would be released and the device legally no more a controlled substance than coffee or caffeinated beverages. Might be more expensive to extract from alternative plants but it would go a long way to avoid FDA attempts to over tax it.

Very nice idea! Problem would end up being money though.
