So basically,
(d) A violation of this section shall be an infraction punishable by a fine not exceeding two hundred dollars ($200) for the first violation, by a fine not exceeding five hundred dollars ($500) for the second violation, or by a fine not exceeding one thousand dollars ($1,000) for a third or subsequent violation.
after two violations (is that same as "counts"?) it's a grand per. And they provide a database....IDK if it costs $$$$ to access or how they control that or will even implement it (15 yo kid A gets 18 yo "kid" B to order stuff for him. -OR- 18 yo kid "B" sets up his own little e-cig retail black market with 200% profit margins...)
Also, it looks like it only affects businesses in CA doing business in CA. So they killed business in CA (if it passes). Any retailer outside of CA can just tell them to "go jump". No? I mean, when does a state mandate override people's right to order stuff out-of-state particularly it's only bad IF IF IF it happens to be an under-18 yo and IF IF IF the non-CA-seller didn't validate age on the CC transaction...which is enough due diligence IMHO.
I have no problem with them requiring a signature by an over-18.
So now I don't know what to write. CASAA gives an example for those in CA to write.
Basically, the whole bill should just require registered mail, picture ID for 18 or over. The rest is B.S. and not effective and extra waste.
