I read the ECF terms of service just now and found that I should leave.

YOU AGREE that by using this Website you enter into an AGREEMENT with ECF that these Terms and Conditions apply and that this document is a fair statement of the Terms and Conditions of Use or Terms of Service or ToS for this Website and that if you do not agree with any statement here YOU WILL leave the Website immediately

Fairly straightforward. If I do not agree with any statement in the TOS I should leave.

Section 3, 3. Use by smokers only starts off with

Ecigarettes should not be purchased or used except by persons who are already smokers of tobacco products.


I never smoked tobacco products and I purchase e-cigarettes, and I feel that I should purchase them.

I continued reading the TOS and came across a few areas where I have some questions about my feelings and the feelings of other posters.

The forums, and the site in general, is owned by a UK company and governed by UK law. It is not part of the US government so there is no issue of free speech. I understand and agree that they may set the rules, I am off now to get a clarification from the Website Admin and if they agree with my understanding of the TOS goodbye.

Terms of service always seem to get a bit more bogged down by people with *other certain rights* or *special needs*_which usually morphs into anybody and everybody who wants to play (or cause trouble).

I joined here because I was a smoker who wanted to quit smoking and needed the help and information to do so. Thankfully, I managed to do that, and fairly easily. .....s and giggles don't really apply to me. So, WHAT'S YOUR BEEF HERE??????????

While I agree that, yes this is a private forum and it's owners have every right to enforce any rules that they see fit, I do think some of the flippant posts are unkind and unnecessary. We have several posters that are not ex-smokers and to read that the rules basically state that, people who are not ex-smokers are not welcome, was a bit of a surprise to me.

I think the problem is probably that the OP isn't realizing that there is a legal term 'agreement' (meaning a negotiated arrangement) and then there is the word 'agreement' (meaning harmony of opinion). Acknowledging the TOS does not mean you are obligated to share the views expressed, merely that you agree to abide by the rules laid out therein. But if you disagree strongly enough with what's pretty much just a legal disclaimer, then yes the solution is to leave the community.

First of all, they are saying that e-cigs are for smokers as a disclaimer; i.e. this forum is not in the business of supporting nicotine use among nonsmokers. It is a disclaimer.

Secondly, this is a private forum. It may be under UK law per se, but it is ultimately governed by the people running the website, and they have the final say about what goes on here.

Probably the reason the replies can tend to be a bit flippant is that the OP comes off as a petulant 7th grader who doesn't like what he's being told. Really, this is a forum for those that enjoy Vaping, nothing more. It is not a platform for someone to try to change the world or any other such nonsense. If the Op feels the specific language of the TOS are so offensive that they cannot abide it and must leave then Hasta La Vista! I've found the people to be nothing more than helpful mostly. I am almost at a year cig free and I am thankful for this forum in particular for that momentous occasion. Do I agree with everything they do? Nope. Will complaining about it andstomping my feet help in any way? Nope. I wish the OP the best but either get over the issue or move along. Just the public bashing of the TOS is of course against the TOS. That's my 2 lincoln cents. :D

He's not a ex-smoker, he seeking clarification for points of the TOS that he's not clear on and if he can't agree, he's going to abide by the TOS. How is that trying to change the world?

If this were a case of just trying to abide by the TOS. The OP would have just gotten his clarification and left or not. This thread would not even have been created IMO. Instead he has publicly posted his concerns instead of just messaging the admins. That to me just smacks of someone trying to get something they disagree with changed in a very passive way. I could be wrong I really don't know the OP from a hole in the ground. To me it just comes off in the wrong way. Re-read my post teach, I never stated anyone was trying to change the world.
