I Don't believe it is. I believe it is Statutorily defined as a Drug Delivery Device.
Because of the Intended Use. ie: Cessation of Smoking verses Recreational Use
We had to go down the Recreational Use route in Court back in 2009/2010. The Alternative was Unacceptable.
So from a Statutory standpoint, if the e-Liquids we use contain Nicotine which is Derived from Tobacco, then the e-liquid is a "Tobacco Product".
Like it or Not. That is what we Successfully Argued for in Court. And that is what we Got.

Seems one hand doesn't know (or care) what the other is doing..We are in the middle of a really serious opioids crisis in the US, with hundreds of opioid addicts dying every day. Yet I saw on the news last night that the FDA just approved a new pill opioid that is 10 times stronger than fentanyl and 100 times stronger than morphine. Now please tell me, what is the logic of that? Big Pharma wins again. Go figure...

That is because the alternative was that nicotine would be classified as a drug and folks that would be a disaster. We can afford to buy nicotine today because of this ruling. Had it been classified as a drug, none of us could have afforded to buy it. Plus it would not even be available except through prescriptions.
Having nicotine classified as a drug is also what the FDA is trying to push through the back door today, they are just not being very vocal about it. Just keep watching, it rears its ugly head every once in a while.

Officially they didn't get what they wanted (drug delivery device) but they made it so there is barely any difference now. To my knowledge there isn't a single approved PMTA for a vaping device or an e liquid.

There’s lots of people who need opioids to be able to lead a halfway normal life, because despite what you hear right now in the media, it is absolutely possible to use opioid painkillers as a long term solution - most other painkillers are either almost useless if you’re seriously hurting, or they will cause serious organ damage within a relatively short time if you take them regularly on a high dosage. Also, if you do get addicted, there are drugs that can help you get off of them without the horrible withdrawal symptoms, so it’s not irreversible.I have a script, all legal for an opiod.

It's already gotten that way. Had a a-fib implant removed, asked for a single (1) Tylenol 3, to help sleeping.Let’s just hope that the result of this crisis won’t be that most doctors will be scared to prescribe opioids in the future.

When I'm watching comercials on a dvd for upcoming movies and I'm digging on some pretzels and pop...then one of those stupid ads starts, I put down my pretzels and pop, go out to the car, light a cigarette, smoke it then come back inside all chilled and resume my snack-fest.
Otherwise I'd be throwing pretzels and pop at the tv and Mrs. States don't dig on me raging like that.
