About the only amendment that will not be affected in the future. All others are subject to be ratified.

16th Amendment

The Congress shall have power to lay and collect taxes on incomes, from whatever source derived, without apportionment among the several States and without regard to any census or enumeration.

They have been chipping away at that Right for years

What about the leather goods I make and sell? Does the cow own the trade mark to her hide, therefore I can't sell it?

I believe that the "First-Sale Doctrine" applies to Products that are Manufactured in the USA and Sold in the USA.

So they do Not fall under this Ridiculous Court Case.

Argggggggggg. Well that put my BP up a bit. What next garage sales and flee markets. Someone needs to flush the big toilet in Washington DC. May need to flush it twice as all the stuff there will likely clog it good. They need a (none of the above) place on the ballots. Know what you have when you have a half full ship of Washington Bureaucrats. A need for more W. B's. to fill the ship up.

Or maybe give it an enema!

One thing that people aren't realizing is that this law is potentially a HUGE gun control move. About 30% of the firearms sol each year in the US are "Face-to-Face" private sales, between two individuals. And of the guns sold by dealers, about 10% of them are used, trade-ins, or pawned.

This new law would make ALL these sales illegal, effectively destroying nearly 40% of the firearms sales market, and making it impossible for collectors to sell of their old stock to get new pieces. It would also make it illegal for ANYONE to transfer a firearm to another individual--for ANY reason. No more gifts of a .22 rifle from grandpa on your 10th birthday. No more "inheriting" dad's collection of hand-engraved hunting rifles and trap an skeet shotguns.

In other words, once you buy a NEW gun from a dealer, you have to keep it for life. No selling, trading, pawning, or gifting of firearms.

Think about that, folks. Think about what this law REALLY means for Freedom--freedom to engage in business transactions, freedom to own and operate your own business, freedom to KEEP AND BEAR ARMS in defense of your home, property, and family against ALL ENEMIES, foreign AND DOMESTIC...

Wake up, folks--those who would control your lives are FAR more evil and duplicitous that you are even capable of imagining. Until you are willing to admit that our nation (and the planet) is being run by a small group of evil, blood-thirsty, sociopathic control freaks, anything you think you know about politics and politicians is just "unicorns and fairy-dust" delusions...

That's a good point. Many people don't understand the "First sale doctrine". That's why we see items such as Vivi Nova knock offs, sold as a Vivi Nova. If I buy a Vivi, I want to know I'm buying a Vivi.

I figured it was a Joke.

But I wanted to inject the "First-Sale Doctrine" into this thread because I was Unsure if everyone Understood just what this Court Case Applies to.

I think it has more to do with if the Product was Manufactured in the USA and then First Sold in the USA.

But then again. I might be wrong. I'm not a Lawyer. I only play one on e-Cigarette Forums. ;)

This law will not pass for the simple fact that the businesses it most affects are in the pockets of lawmakers. If it does pass then I welcome you to join me at Theken's Black Market. I would say that this law has no chance of passing but thinking over more idiotic laws that have made it through, you never know (seat belt law for example).

I don't think this is a New Law that someone is trying to Pass.

But an Interpretation of Existing Laws we Already have.

The First Sale Doctrine was made into law in 1908, what is being argued here is if applies if the first sale in made outside of the US. I can buy a new textbook in the school bookstore at Purdue. At the end of the semester I can sell it back and another student can buy it...no problem.
The issue being looked at now would be if I bought that same textbook from a source outside the US. Why does this matter? Because new textbooks can be bought at a much lower new price in other countries. They want to make the First Sale Doctrine not apply to things (copy-written in the USA) bought outside the US in order to stop profiteering on some items.

I dislike it because it is being looked at as a blanket law, not one that really needs to be judged on an individual basis.

I want off this planet now....

Just makes me so sick that anyone would even fathom that presenting such an idea is even in the realm of acceptable to any degree.

Now, seeing that the article is from June.... & ebay is still going I'd say we are in the clear. Amazon and Ebay have the money to burn to make sure it wouldn't happen. Just a thought there.
