Total Ban

I heard on the TV last night that some small town in the US was debating a total ban on the sale of all tobacco products, specifically including ecigs. I have a feeling it would sink in the courts if they tried it, but it could happen down the road. They didn't say whether this would also ban the use of those products in town limits.

just remember in certain places it is prohibited by law to carry ice cream in your back pocket...small places will do stuff like that because they can but it wont work on a larger scale

Yeah I think it was a town in Massachusetts. So it doesn't surprise me. Better for all the towns nearby.

I can see them trying to try banning on smoking in public but I can't see them trying to ban the sale of all tobacco products. It would never pass. Too much money is made off the taxes from cigarette sales. As for e-cigs, i wish they would stop trying to classify e-liquids as a tobacco product. As for vapes themselves, most they can do right now is try regulate the juice itself and cigalikes. Vaporizers themselves are classified as aromatherapy devices. That is why the sale of them is legal and not all vaporizers will vape e-juice. Because of the medical uses for them, it makes it harder for them to regulate them. Which is why they are trying to target e-juices themselves.

The Ashland Mass board of health unanimously voted to ban the sale of flavored tobacco products, including e-cigs, outside of smoking bars and (non existent) retail tobacco stores.

The town of Hingham had a similar vote scheduled, but it was postponed because one of the health board members couldn't attend.

Alright I read the article. Their just trying to take away more and more rights. Even if banned from selling it people will just go to the next town over to get it It won't do anything but hurt local businesses.

There are still counties in Georgia and elsewhere where it's illegal to buy booze. People just drive over to the next county. This is basically the same thing.

CVS made a choice to stop selling tobacco, and for a pharmacy I thought it was great. But it did affect them. Me, for example, they were the closest store. So we'd go in there and get our smokes and maybe milk. Now we never go there, no need.

As for banning e-devices and tobacco in an entire town? That is insane. Why the e-devices? It'll only hurt any vape shops, you can readily get your stuff online for vaping.

Over here, it has been illegal to sell tobacco products in pharmacies for over 20 years (I think even 30 years). It is a case of common sense when you consider the nature of the business, yet an example of the government imposing laws on private businesses. They are still well alive, though. I'm not sure if the cough syrup market went up or down at the time.

Complete tobacco related bans in places where it was legal yesterday is really calling for trouble, though. You can regulate who where and how to get and use the product, but a complete ban is definitely looking for enemies and a lot of trouble in court.

What baffles me is that e-cigarettes are NOT a tobacco product! So why are they banning them? If I stood outside (or inside) a business and toked on my ink pen would they ban them too?

Just make possession of tobacco products a stiffer penalty for those under 21, no biggie, take the same stance as alcohol or drugs, lump em all together how hard is it. these council members are trying to control something that is uncontrollable. an adult will do what they want when they want to spite laws, just take a look at the over crowded prison situation, people will be people..... maybe extreme laws for parents that let their child smoke, 30 days for the adult, in house treatment for drug abuse for the child.. mandatory.... jeez people use your heads.. rant over thanks bunches.....

The FDA is currently calling them a 'tobacco product' if I'm not mistaken. That's what most of the fight is about.
Big pharma pushed for the label "drug delivery device", and Big tobacco pushed for the label "tobacco product". Neither label holds true according to current fed standards of restriction/regulation, so the courts are thus far going with the BT label because there's more money in it and it's easier for the public to swallow.
Little jurisdictions take it upon themselves to march to the drum, thinking that eventually states, and nations will march as well. Antz are everywhere.
