On 12/24/13 I signed up for a "Free trial" offer of an electronic cigarette from the Vapor XS company. The original cost was 4.95 to cover shipping and handling.


From their email confirmation:

My Address was correct as stated in this complaint form.


On 1/8/14 my checking account was debited $99.95 from this company and resulted in an overdraft in my account.
As of this date the trial product had not been received. I attempted to contact the company and was given a run around my the call center operator.


On 1/9/14 the product was received. I called the company again and was told that the 99.95 was a charge for another "auto-shipment" that could not be cancelled as it had already shipped. They also indicated that they could not issue a RMA# because the product had not yet been delivered.


At this point I calll my banking institution and reported a fraudulent claim. The banking representative assisted me in contacting the company and getting an RMA issued.


I paid the cost to ship this item back to the company ($7.08) and the original trial product was returned to the company. I was told by my banking institution that I would need to allow 15 business days for them to issue a credit.
On 1/20/14 I received an email stating that the refund of 82.45 had been issued and to allow 3-5 business days for it to be credited into my account.


On 1/23/14 I called Vaper XS to determine why the full amount ($99.95) had not been refunded. Again, I received a run around and the operator stated that no one was available in "that department" to assist me.
I called my banking institution again to request assistance. At this point I was told the difference of $17.50 was a restocking fee. This restocking fee was never mentioned in the advertisement, nor while I was on the phone attempting to resolve this matter. However, upon reflection I now see that it is included in the "Terms and Conditions".
I believe this company is engaging in unfair business practices by encouraging consumers to "Try before they buy", yet not getting the product to them in a timely manner to actually try the product and cancel before the 12 day period has expired. This is equal to a "bait and switch method. Then once, a customer cancels they have still profited nearly $23.00 per transaction.
This company needs to be investigated for these practices and not allowed to promote the product as a "Free trial" unless they are willing to change the trial period to reflect a 30 day period, or a period that does not commence prior to the consumer actually receiving the product.


On 2/20/14, I had not received my refund from this company. It had now been 15 days, (which is the acceptable waiting period according to Visa). I called the company back and they were very rude. The support person stated that I had been refunded and that I would have to speak to my financial institution. So, I called the Fraud department again. After explaining the situation again, they agreed to issue me a “temporary credit” for the refund and now, they will pursue the company for the issued refund.
I just want to get this information out to as many people as I possibly can so that this does not happen to anyone else. I would love for them to not become profitable in the e-cigarette market.

They finally, (2 days after the 12 day "trial" period) they sent me the "Trial kit", I never opened the package to see what was in the package. They charged me the 99.95 1 day prior to receiving the item. I sent the trail kit back. Apparently, that is what the 99.95 charge was for..the initial kit which they state you pay 4.95 for. Not! If you don't cancel within the 12 days the trial kit costs you approximate 105.00! And, then they have you set up to receive product every 30 day and charge your account 99.95 each month.

The subscription was cancelled, so I have no clue if anyone ever receives product after the initial kit.

Honestly, the website just looks like one big scam to begin with.. no tabs for any products F.A.Q. It's good that you put this up here for new members cause really that is a huge scam. Theres no such " trial " in vaping. You start off with an eGo type battery yourself and if you like it you continue if not, it's not right for you. There should be no such thing that charges you that much money for a trial period. Glad you put this up here for others to see!
 
You have to be very careful with sites like those. Its always stated in the fine print but they know most people don't read it. I got into a shoe site that stated in the very fine print that once you order you would automatically be shipped shoes each month for a set price until you cancel. Most people who sign up do not notice that and feel scammed.

Thanks for the heads up though.

Sorry to hear of your experience charylec but I'm thrilled that you chose to post about it.

Offers such as the one that caught you have a long history of being scams. If there have been any that were legit I don't believe I've heard of them.

Here's to hoping this thread is seen by many and once again the word is spread that there is "No Free Lunch"!

Avoid "Free Trials" ALWAYS!

i got sucked up into the same thing.
not once,but three at one time.
luckily due to a defective charger when i googled the maker to contact them
there were tons of complaints similar to yours.
some more googling found the other two were the same deal.
i called them all immediately and demanded and got rma numbers.
i paid the shipping back.two of them even credited back for my initial purchase.
i used a pay as you go visa though and i'm sure that's why i didn't get much hassle .

another thing it is fraud.the u.s. attorney generals office will investigate this sort
of thing.
this is actually an old scam that has been used on many different types of products.

Charyl, I think if you stay on this site you will learn A LOT. I think you will be amazed as to what is out there and how much further you can go beyond the Big Tobacco start-up kits. I never purchased one, the main reason being I knew they were owned by PM, Newport, etc. I've smoked Marlboro Lights for 22 years, I've gotten the free stuff from saving my miles, all they were doing was giving me tokens to make up for the chemicals they were also giving me. All they are doing now is making me suffer as I try and make the switch to vapor. Please don't be afraid to learn. You will be much happier when you completely break those ties from BT.
