Thank you for posting the link to this story. I don't have enough post to post a link yet. I just finished the follow up story after doing an exclusive interview with Jason Dewing, the man who got the ticket. If you can find it maybe you can post the link for me again. Sorry to be a burden, but this is important news that I feel everyone who vapes should know about. The title of the article is Exclusive: Man found guilty of electronic cigarette law that does not exist

I promise to become more active so I'll be able to post my own links soon. Thanks again for helping out!

yep, they told me that the camera systems are being used for that. Also, the unmanned aerial vehicles will secretly be following any clouds that escape out a window. Its all about big brother. Also, don't say the word "vaping" on the phone while driving. Another organization will listen in, triangulate and 4-5 police cars will surround you. A big government helps us to manage our life.

I'm really thankful I live in Texas. Last week I chatted with two police officers, in uniform, in a local vape shop. Both were trying to quit smoking. I was joking with them about being nervous to let a policeman see me vaping in my car. They thought it was funny and told me not to worry, they vape in their squad cars.

I live in WNY and pass cops all the time vaping while driving in my personal vehicle, haven't had any problems yet.. For my job that's a different story..I drive a truck for a large disposal company and got warned by our bosses no smoking/vaping, eating or drinking while driving because its considered distracted driving.

According to that article he was cited for using a cell phone NOT cited for using an ecig. VERY misleading article I suspect. :(

Very likely the officer saw a light coming from the end of the ecig and presumed it to be coming from a cell phone and didn't believe the guy when he explained he was not using his cell phone, if he did bother to calmly explain. It's crossed my mind more then once how easy it would be for that to happen, especially at night in the dark.

My husband was stopped once at night because the officer saw the light from his cell phone and thought he was texting. My husband had picked up his phone to see the time. Ironically my husband doesn't have the slightest idea how to text and doesn't even have texting on his phone. He calmly explained that to the office and offered to let him look at his phone. No problem once calmly and politely explained.

I'm sorry you feel this article is misleading. Maybe you should go back and read it again. You should also read the follow up that was published today to get the whole story. He was originally pulled over because the officer thought he had a cell phone and when he went to court for the ticket the officer couldn't even tell the judge what color the phone was or identify it in any way. The guy proved to the court that he wasn't using his cell phone so they went after him for the e-cig calling it a portable electronic device. There is no such law that classifies an e-cig as a portable device. He did explain to the officer that he did not have a phone in his hand but instead had his e-cig and the officer was not trying to hear his story. He was convinced that the guy had a cell phone.

Earlier tonight I read a post in a vaping community on Facebook about a guy who says he's the first person in US history to ever get a ticket for vaping while driving in Upstate New York. The problem is, there is no such law!

Has anyone else ever heard of such a thing?

I'm new here so I'm not allowed to post a link to the story but I'm sure it will be in the news in the coming days. You know how the news loves to pick on us vapers!

I have heard of people getting tickets for distracted driving. Maybe he was dripping...
