I get that but doesn't BlueCheck which is state/federal compliant cover their behinds for that?

Depends on the state. For some it's not enough. In other cases states enact a requirement they didn't know about. And for a few, they don't even trust that online age verification will be enough (for the most paranoid of vendor).
