WTF Commercial for a smoking cessation prod on TV!!

I was just watching some TV and saw a commercial for a product called "it's quitting time". They are for pills that guarantee you to quit smoking or your money back. They are not FDA approved and they essentially call their product a smoking cessation over and over. So we get in all this crap and have to fight while someone posts some Mickey Mouse pills that of coarse do not work (You know the bs ads) boldly on TV and have no issue!!

I wonder if the FDA will yank them?? I thought it would be interesting to share with the board even though it's not an e-cig. The link is

Well, now that we've given their site way too many hits...

I'm no expert, but it looks to me like they're getting away with it (for now) because of a few things:

1) There's no nicotine.
2) They don't say anything about ceasing to be addicted to nicotine (addiction being a disease). What they say instead is that their product promotes healthy brain function, which can lessen the symptoms associated with nicotine withdrawal.
3) The product contains a phospholipid, which is a major component of cell membranes. Their claim is that nicotine makes affected brain cells rigid, and the introduction of a phospholipid can ease that rigidity, again, lessening the withdrawal symptoms. Phospholipids would fall under the "dietary ingredient" classification, making the product a "dietary supplement". It does have to follow certain guidelines laid out by the FDA to be marketed as such, including full ingredient lists and that famous disclaimer at the bottom of their site.
4) All allusion to quitting smoking is in regard to "the program", which includes a support group, which is generally regarded as an effective weapon against any addiction.

Of course, at any time the FDA could look at that and say "whoops, you crossed a line here" and take it off the market and have them get approval as a new drug.

I too saw this commercial on TV and of course scrutinized the living crap out of it... (just as I have the new Chantix commercials you will note have been pounded out 15 times a day right now????)

However, TheIllustratedMan came up with the same conclusions I did. They can totally get away with it! :)

Edit: I did not come up with #3 as Illi did... but that appears to be a good one too! LOL

They are getting around the regulations because they are a "supplement"..lol mostly made up of various oils.

Even though they claim it to be a "supplement", they also outright claim it to be a guaranteed smoking cessation product. Isn't that the issue many had with the FDA? Mislabeling? It is my understanding that a product needs to go through FDA approval before you can call it a smoking cessation product.

See my post above. I can't vouch for the commercial (haven't seen it) but as far as the site goes, all cessation claims are made for the "program", which is a combination of taking their pill and a support group. The pill itself is a supplement, a support group is generally considered a boon to anyone trying to quit, and together they form the "program", which is "guaranteed" to help you quit. I don't think the FDA regulates guarantees.

I haven't been to their website as it was late last night however on their tv commercial, they claim it to be a product to quit smoking. They guarantee it and they mention quitting smoking with thei product on several occasions.

Sorry for the "prod",, in my original post,,lol. Then again you never know! In dealing with idiots at ash and other organizations, someone could definitely use a good cattle prod tap.

But didn't the FDA go after Cheerios for guaranteeing it would lower cholestrol? Not sure why they can get away with guaranteeing people will quit smoking. I understand they will get away with the "supplement" part, but I don't understand the guarantee. I've also seen this commercial and was swearing under my breath while watching.

I think Sherid hit it... it doesn't look like smoking.
