Having been part of previous rallies, I thought this one was one of the better ones.

Turnout is a huge issue. Weekdays, when the statehouse is open, are sparsely attended. This one had a larger turnout, but the numbers were pitiful. Less than 10% of Hoosier's employed in the vape industry were there. Think about the the number of vapers that support each and we are talking a tiny fraction of a %.

The horrible truth is that it takes either huge $ or huge #'s to change what government has set out to do.

Thanks DC2. I'm always amazed by out-of-state folks supporting this fight. We've had more than I thought possible already.
There are no "out-of-state" folks when it comes to vaping.
We're all in this together.

Or at least we should be.

I think the Reason you are seeing such Widespread support is because their is an Organized Effort to fight what Vapers see as an Affront to vaping thru Reckless and Misguided Legislation.

So, when Rod Ratcliff – Centaur Gaming (Casinos), Zak & Bob Laikin – Monument Vapor & Indiana Vapor Co., Jon Sinder – Crown Liquors (package liquor stores), along with Doug Mulhaupt & Mike Gibson – Owners of Mulhaupt’s security all decided that they would pool their resources together and force the entire state of Indiana to comply with their standards or be left in the cold, they got what they wanted, a monopoly.

We have a brief updated, longer one will come later today. The hearing was less than 10 minutes! The lawyers all met with the judge just prior to the start. That's what we are standing around waiting for in the picture. They all agreed to a "briefing schedule and timeline". This allows more information to be presented and gives it to the judge in a more concise manner. There were other really good things that will likely help our cause. Stay tuned.

Evan McMahon posted a video update and I don't know how to share videos or know if that's even allowed. He stated the meeting today went really well and repeated mostly what's in the quote just above this post. He also stated the judge seems to be a good judge in that she wants as much information as possible but because this will all take more time her decision will most likely not be given until right about the June 30th deadline (the deadline for vape shops to be compliant with regulations they can't meet).

So while this is really taking things down to the wire time wise it sounds like the judge is going to take her time and give this her full attention/time. That's the best we can ask of her.

Lawsuit Update - From the attorney:

On Friday afternoon my office filed its brief, affidavits and exhibits in support of our Request for a Preliminary Injunction.

The purpose of the Preliminary Injunction is to request that that status quo be maintained. In other words, to keep things as they are right now until lawsuit is finished.

Most importantly is that the June 30, 2016 deadline for the approval of applications by the ATC be set aside while this case is more fully litigated.

This is not the litigation of the full case, just the reasons why the status quo should be maintained.

Preliminary injunctions can be hard to obtain. In this case, we have alleged a violation of the Indiana Constitution, as well as the ATC’s failure to comply with the Indiana General Assembly’s dictate to enact permanent rules, as two main reasons the deadline should be stayed until the full case can be litigated. These are good issues in which to ask for a preliminary injunction.

I must emphasize that the Indiana Supreme Court, as late as 2011, has said that these should be rarely granted. We’ve argued in the brief that this is one of those rare times.

Stephen Donham, an attorney in my office, will be sending file-marked copies of the brief and accompanying documents.

Also a big shout-out to Evan McMahon, who has put a lot of time into helping my firm make this brief simple, concise and compelling for the one person who matters now – the judge.
