I feel extremely uncomfortable if I am out and about and I see a police car especially at night , with my pv on my person.

How will I explain the bottle labeled "caramel mocha" or that bottle of dk with the green cabbage like plant on the label, in my pocket. What is that shiny thing with a mouth piece?

I recall a member of this forum was stopped at a road block. He was in a taxi. They proceeded to check his bag.

Better to be safe than sorry.

I kept thinking what are we going to be charged with? My friend gave me the stuff as a gift, so I never import or buy, they never say not allowed to use. If I go to court what are they going to charge me with?

You see, most of them who posted here saying they kena fine, is "kena fine", they never went to court. No judge in the right mind would rule in favor because it will be a first case and technically there is NO LAW restricting the use of electronic cigarettes in Singapore. Is there?

On the other hand, we've never had a post with the person who kena fine stand out and clarify. All of these posts are friend's friend or friend say one. How true is all these stuffs? Is there a newspaper report on kena fine? Although the government literally controls the mainstream media it doesn't mean the media can give false information right?

I've not seen any mainstream media report so far. the only ones that keep appearing are targeted at analogs. Is there a mole here trying to spread fear? just like the elections rumor that says the serial numbers are tagged to our identity.

Yes, there was an ST article on Home section in 2009 reporting that a few vapers were caught and 3 were charged in court for possession and distribution. One of them was a "big time" seller who kenna close to $20k in fines. Those not charged were those possession for personal consumption. They were given a "stern warning."

If you are unsure what the current law is on vaping and PVs, please read the Smoking Act and Tobacco(Sales and Advertistment) Act. They are inter-related.

Pursuant to Para 2 of Tobacco (Control of Advertisements and Sale) Act,

"tobacco product” means any cigarette, cigar or any other form of tobacco, or any tobacco derivative or substitute, including any mixture containing tobacco, or any tobacco derivative or substitute, but excludes any medicinal product registered under the Medicines Act (Cap.176)

“tobacco substitute” means any article, object or thing that contains nicotine, but excludes tobacco, tobacco derivatives and any medicinal product registered under the Medicines Act."

“use”, in relation to any tobacco product, means smoking, chewing, inhaling, ingesting or otherwise introducing the tobacco product or any of its constituents or emissions into the human body (whether by oral means or otherwise);

PV/e-cigs/electronic nicotine delivery devices are, therefore, classified as a Tobacco product/substitute.

Pursuant to Smoking (Prohibition in Certain Places) Act,

“smoking”, with its grammatical variations, means inhaling and expelling the smoke of tobacco or any other substance and includes the holding of any cigar, cigarette, pipe or any other form of tobacco product which is alight or emitting smoke;

So no you may not vape in places that analogue smoking is prohibited.

If you're wondering whether is it or is it not illegal, as long as HSA says it is illegal, it is illegal. Because the Tobacco (Control of Advertisements and Sale) Act is a statute and it is up to the Chief Executive of HSA to determine it's interpretation of the regulations stated.

I personally feel that the word 'possession' wasnt included for a reason, it is to help us. I feel that we shouldnt keep 'challenging' the system indirectly. If the big brother wants to change the law, they can do it anytime. So the best thing is to not touch on this subject there being no law on possession.

Word form the Horses' mouth. It's only illegal to import or sell or import with the intention to sell. It's not illegal to possess or vape. BUT, since it's not legally avail, the PV must have been from sumwhere. Either YOU import in or u GET it from SOMEONE. Another Q will be, are u a SELLER, Importer or user ? :D

There is. U just have to dig deeper into all the related statutes. What's on HAS webby is just prima facie. U have to read and understand the tocacco, smoking & custom duties in entirty.

for me, i just vape, dun really care about who catch me, if really caught, just say got it in malaysia lor (innocent eyes big big). been like that for a year, even in kopitiam i also let go only, i not encouraging anyone to do that. i just feel that a change should come, smokers already been cornered to a smoking corner, soon no more corner... then vaping with all its obvious benefits still kena pushed around by industry law, bullies, i dun like bullies. so for me, i just promote health to people when they asking me what is it that i am "smoking". then i will start explaining vaping and its healthier ingredients, and then point them to a convenient website that caters to SG needs. becos i quit smoking cos of vaping, i got healthier, quicker and breathe lots better, so wat the heck, i no need to hide cos i did no wrong, this is my quitting smoking regime mah. sorry arrr, when i start talking about certain country's laws, i get angry....
