As with anything related to ACA, HCR or Obamacare, no one really knows. My guess from what I have read. I am in tax and have-had many single practice docs as clients. 10 have sold their practice and retire instead of dealing with this or they are being bought up by hospitals. If you purchase through the exchange then, they cannot impose the surcharge. Employers can by hiding it in cessation programs.

From everything I have read there will be a huge challenge as it is discrimination and no other sector is targetted. Well I hope at least.

If you were a 20 something perfect health and a smoker would you get health insurance or pay the penalty? Providing your workplace doesn't offer? Many small businesses do not.

Air, the real hurt is going to come in a few years when they throw all spouses off plans which some have already done, I dont qualify for the new act( and i still think its the right direction, never seen a gov program work in the beginning no matter what it is),gym+cardio+good luck.That sounds like my retirement plan=lottery.

The surcharges will start cheap...as little as 50 bucks, but they are allowed to charge up to 50% surcharge.

The tax credit can NOT be used to offset the surcharge, so even low income individuals will need to pay the surcharge out of pocket.

I don't know how they will cover NRT as part of a Cessation program. Some companies are putting NRT's in the same bin.

One thing that is good.....From what I under stand, even if you are "caught" they can't take away your insurance....They can only charge you the surcharge. You'll have to pay the surcharge for the remaining of the year.

Its not the nic that kills you,its tobacco,extracted nic in low amounts is actually healthy for the body and mind.

Since when have health insurance companies cared about your health? For the Health Insurance companies it's a win win. You're a vaper, so you have actually lowered your health risk, but they get to charge you the high risk rate.

They will always say, the only way we can determine if you are a smoker is to test for nicotine. So there you go. Good luck.

I'm already working towards zero nic by the open enrollement next year.

There are a lot of "lifestyle choices" that are more hazardous than vaping or even smoking however, it is not politically correct to rate and charge appropriately for these "choices". Tobacco is the only "government approved" scapegoat that I am aware of. Tobacco is the only product in the US that the tax is more than the value of the product.

No kidding. Could you imagine if they instituted a 50% surcharge if you get a DUI? What percentage of people popped for DUI are popped on their "first time". .1 %? If you get popped for DUI, odds are you've driven while drunk more than once.

OH WAIT.... Can't do that. Then the senators and government officials would get popped....What was I thinking????

How about Motorcycle racing, Skydiving, or just living in some cities. Neverending list that makes sitting home vaping look benign.

I just made my selections and have until the 31st to get the blood test. There is no form for us. Take the blood test, that decides your status. Today is day 3 of 0mg nic juice for me. I figure that by Monday, I should be good to go. It's not lying if THEY choose your status based on the results of the blood test, right?

Are you smoking? No...
Are you currently using Nicotine? No...

That's the plan I will take. I'm weaning myself down right now. I guess the only thing that would be a problem is if you decide to "quit" just to pass the blood test, then later, when you are getting care, they notice you have nic in your system.

If you stay at 0mg juice, you should be good to go. If you are purging just to get through the test....well you might get bit by that.

Day 4 of 0 nic. No cravings, urges, fits, etc.. I am going to schedule the test for Monday or Tuesday.

I have already quit smoking. I currently am not a tobacco user, and I am also currently not a tobacco by-product user. If I pass the test, then I legally qualify as a verified non nicotine user. If that happens, I see no reason to start consuming nicotine on a reglar basis. After 30 years of smoking and then finally getting nic free, it would be stupid for me to get back on nicotine. I plan to just keep vaping 0mg nic. That being said. If I get to the point where I have an urge to smoke, I am heading straight for that partial bottle of 18mg that I got with my starter kit and never finished. I have some backup 12mg as well.

I didn't really think that I would be in this position at this point in time. It is a pleasant suprise to be sure.
