I'm no legal expert by any stretch of the imagination, but I just saw this as an accessory to the JOYE 510.
TITAN/TORNADO-Lazer Pointer and Pen Light Adaptors

Makes it into a laser pointer...

So how is it the FDA can ban a battery that screws into a laser pointer?

It seems if we break it all down into individual components, the ban doesn't make any sense...

- They can't ban batteries.
- They can't ban atomizers as anyone with a soldering iron can make one...
- And they can't ban a plastic container that holds plastic weave AKA carts.

So they're trying to ban the sum of the parts?

Seems to narrow it down to only being able to go after the liquid...and since anyone can technically make that too...this entire argument seems really absurd to me as far as banning it...

Especially when I look at the multi-use of a battery it seems crazy they can classify it as a drug delivery device...

hopefully this will leave regulating the liquid as the only option...or it looks like we'll all be buying a lot of "laser pointers" in the future...

You are correct and I'm not sure how this will unfold in the future. The battery and holder (if they aren't one and the same) can easily be fitted with a bulb or laser light. That would be hard to ban.

Now you only need a heating element to vaporize herbal liquid which they have already been stopped from controlling and you have all the necessary components.

You'd think our government would have something better to do with their time and our money, but I guess not.

i'm no lawyer, but it seems this would be a powerful argument against the FDA banning it or labeling it as a drug delivery device...

could you imagine using a 510 battery as a laser pointer demo in court "this is what the FDA is trying to label as a drug delivery device" then use it as a pointer to go over their power point presentation...

would almost make FDA's argument farcical...

i hope the lawyers on our side are worth their salt and are gathering these types of arguments...

as the only thing the FDA should reasonably go after is the liquid...

if not - like i said...i sure will be importing a lot of "laser pointer batteries"...

What they should do, in a world where they actually are working in our best interests, is simply.

It's out, its pervasive, it has large following. You are not going to stop it. So do the right thing. Run actual tests. Interview and examine users, longterm and shorterm. Report the factual results. Let adults make up their own minds.

Then I woke up.

The heating element to vaporize herbal liquid, is that similar or exactly like our atomizers? I'm intrigued, I didn't realize this option existed.

herbal liquid = eliquid

Regardless of it's origination.

Making an xtract of Tobbacco is no different than making, say an extract of catnip.

I am just sick of the non-smoking community making all the rules. I get banning analogues in public places like restaurants and office buildings. They force us to quit but only on there terms. GFY I say. Vaping is harmless to anyone around it. It doesnt alter your thinking, so it isn't any danger to others. You would think the non smoking community would be ecstatic about this ecig. I guarantee at least 50% of non-smokers drink alcohol. All I can say is if someone ever tells me I cant vape in a certain area I will tell them to go F themselves.

that being said, the same argument could be said about wanting to ban draino - it's a poison and will kill u dead as nicotine - caution always - better yet, napthaline, gasoline, the stuff in paints and paint thinner and anything else ppl can abuse by breathing - (none of which have even hints of health benefits). I'll take a ban on nicotine AFTER they ban all these other products to prevent their abuse. until then i DARE them to ban nicotine extract then i'll extract it and sell it MYSELF!!!

anyone remember their history and the Whiskey Rebellion? the FDA can't win and they MUST know this.
