And most importantly they have become dependent on that cash flow. At this point if cigarett tax revenues go down someone loses their job. I talked to a guy in the mall trying to sell some proprietary gel based ecigarettes, and he mentioned that he had a run in that morning with the government. they asked all sorts of questins a d demanded to examine his stock. It wasn't the FDA or the ATF whom you would think of as being the appropriate agency, it was the state IRS.
The current court case is all about determining how electronic cigarettes will be classified.So one thing I don't understand fully is how ecigs and nic-juice are classified now. Clearly they're not classified as medical devices at the moment, which the FDA is trying to change. Are they also not classified as tobacco products?

And that is what they would be classified as if nobody was challenging that in court.
