... This new tactic of litigation will be quite effective. Small companies can't afford to defend themselves...

Tell me something I Don't Know.

And BTW. Brining Law Suits against those who can Not Afford to defend themselves so as to Promote an Agenda is Nothing New.

Whats more interesting here, is this subject is YEARS old.

Back in 2009-10, the topic was literally run into the ground, all sellers of all ecig related devices and or required options to use them, were publically forced to NOT make such claims. Even before paypal started cancelling accounts for moving nicotine related products.

So it took this long to get litigation on it? Malarky, what a joke.

The plaintiffs should get a court order mandating them to have large (graphic) warnings tattoed on their foreheads, listing all their carcinogens in their breath. Same for their cars, clothes, houses etc. To protect the public and the children.
That would not be enough. They'd have to be banned from breathing indoors, otherwise, to be fair, vapers should only need to have warning tattoos to vape anywhere they want.

The sad reality with any class action suit is that the defendant(s) must bear the burden of disproving the junk science or any other specious position as opposed to the plaintiff's class proving it.

The only winners and the only people that matter in any class action are the attorneys.

CEH's recent deceit seems to have people drooling over what they percieve as easy money, but I think BT will easily defend these junk lawsuits, and CEH will eventually be in trouble, at least as far as their reputation goes.

I Really Don't Worry too much about BT and Lawsuits. They have a Legal Staff the size of which Rivals many Small Towns. And have the Monetary Resources that Rival most 3rd World Countries.

What is Concerning thou is the Negative PR such Suits bring onto the Vaping Community in General.

And when the Balls are Still in the Air for proposed California Legislation (not to Deeming - Which seems all but Forgotten to Most), things like a Class Action Lawsuit isn't the type of thing I would like people to Think Of when the word e-Cigarette is mentioned.

BT will expose the lies in court, if it goes that far, and that would help smaller companies and shops defend themselves, but I agree, this is mostly bad news.
