I'll just throw my $.02 out there on this. A lawsuit isn't really the way to go on this one. Suing a government entity usually is a losing proposition... they have exceedingly deep pockets for legal defense, and in the end, officers of the court are government employees. You generally do not want to rule against your employer if you can avoid it.

I think it would be far more effective to go directly after the FDA for their actions. When a government agency oversteps its bounds, it is a sign that the agency in question is overfunded. If the FDA were appropriately funded, they would keep their purview to items that are sold as "food" and "drugs". Mainly, this would be pharmaceuticals and food items. Since other nicotine containing products are currently allowed (analogs, snus, chewing tobacoo, etc.), we can assume that any recreationally used nicotine delivery system should be allowed for use. Singling out electronic cigarettes as unacceptable without adequate research shows me that the FDA needs its budget cut until they reach the point that they're not tilting at windmills.

I have written letters to my representatives to this effect and have gotten back reasonably positive responses agreeing that without proper research, electronic cigarettes should not be banned. I implore everyone to do the same.

That's a really good question......

The only problem is, people either don't have money to sue or they are intimidated by the government.

Maybe one could find a lawyer who would do it probono. There are a lot of lawyers out there who do believe in one's civil rights, Not all off them are out for the big bucks as a lot of lawyers get a bad rap.:p

Tell me how they could sue the cigarette companies for the death of smokers. Well they could and they did and several have been settled.The one of note is Cindy Naugle. She was awarded 56.6 million in damages.She started smoking in 1968. Back then there was little published about the dangers of smoking. Phillip Morris said it was her fault but the jury said it was 10% her fault and 90% PM fault. As a result of this lawsuit a class action was filed. Probably anybody that started smoking in the old days were not informed of the dangers of smoking.

I wonder if I can still sue PM. I started smoking when smoking was cool. All the movie stars like John Wayne smoked. We admired the Marlboro man. I was unaware of the potential damages of smoking. Once I was made aware of this it was too late, I was already addicted.

Are there any smokers out there that started back in those days. Maybe we could all get together and file another class action lawuits or have the courts decided no more cases can be filed.

I started smoking in 1972 when I was 16 I was in the Iowa State juvinille home at the time, The staff bought us cigarattes in fact they used them as a behavior modification tool, Yeah the state of Iowa, What do you think???:confused:

Personally if I served on that jury, I'd fight to make sure nobody got a dime from suing tobacco companies. They made a product, you used it. It's that simple. Surgeon General's warnings have been on cigarettes since 1966. People have had 43 years to quit. Prior to that, if you did not know they were bad for you, it's reasonable to assume that the tobacco companies did not know how bad they were for you either.

The bottom line in my opinion is that the tobacco industries are murderers. And yes your probably right about the warnings being on a pack of cigarettes since 1966 but they have done a lot more research on cigarettes over the years and the stuff they put in the cigarettes like what 4000 ingredients??? They know damm well what they are doing. I know the taxes on one pack of cigarettes is like 85%, the pharma agenices make their own stuff that may or may not work, like chantix, nicotine gum, nicotine patches, and even nicotine inhalers, and lozengers etc,
They also make money off medicine if we have bronchitis, and everything like that let alone chemo, radaition the list goes on and on, They will NEVER outlaw cigarettes too much of a money maker for the states, pharma etc. We live in a very corrupt goverment society, And all the while they grease each others hands, Makes me sick...

It is one thing to be responsible for out own actions, but it is quite another to say the big tobacco industeries has no blame, I am curious you I would presume did smoke tobacco since your a vapor now. How many things did you try before you went to ecigs, and failed? To make a remark like that is cold and distant in your emotions, If I am wrong to say the tobacco industry is also at fault, then I stand accused, and I accuse them of false advertisement, making smoking seem glamerous, use to have adds of cigarettes in magazines and commercials. Give us a break:-x

Whoa I think this is getting a little interesting. I do not think that the 911 was a legitimate terroist attack. Just like what I said about the government being so corrupt. Kind of makes you sick to think our own government could be involved in something like that doesn't it? But it is not the first or the last time our government is doing something sneaky, dangerous, decietful, corrupt, inmoral is it????:(
