Cops mistaking ecigs for Other Stuff

I guess it could happen. I rolled my own cigarettes for years (yes, real tobacco) and never once got questioned by an officer of the law. Maybe I was stealthy enough or lucky or both, but whenever I saw a cop close by, I just held it out of sight just to be sure. I've carried this mentality with me into my world of vaping.

I dont agree with the cops, but i can see their reasoning. There are PVs out there, not going to name any, that are designed specifically for other stuff. I work with a guy, and was telling him the story of how i screwed up with my protank on the way home from work, switching it out for a different tank with different flavor, and dumped about 1ml of juice on my hands, asked if he had ever spilled any juice on him and he said he doesnt use the stuff, only other stuff. There are ones out there for solids, there are ones out there for waxy/really thick oils that can be made with other stuff, but just because a few people are using those, it shouldnt ruin it for the rest of us. Personally, i think there is a HUGE difference between an ego battery and a Kanger ProTank in appearances when compared to the ones used for other stuff, and I know a lot of the cops in this area visit shops to see whats out and what is being used for what. But back to my point, just because a few people are using these things for illicit purposes doesnt mean the rest of us are.

This is the biggest threat to the vaping culture. I've never met a CA vaper who wasn't using it for other stuff.

Ahh... You must be from the U.S. crazy stuff down there from what ppl say. Sorry to hear things like that happen in some countries.

It is getting worse by the day here. I'm lucky though since I live in Missouri now which is becoming more and more conservative by the day so it is really hard for a cop to legally stop you here. However a side effect to that is that the other thing apvs are used for is about to become legal here which makes me worried for the future of vape shops out here since they may want to move a direction that would make them more money. I'm in the West County (stl) area and it is amusing because a good chunk of cops in my area went to an academy not in Missouri so they didn't wind up learning some of the differences for the state (like how Missouri is one of 7 Probable Cause only states instead of Reasonable Suspicion like most) so they are always at risk for a lawsuit for doing what is a perfectly legal stop in most other states.

A college friend of mine was sitting in a Dunkin Donuts having coffee, a donut and rolling a bunch of his cigs. He had about 20 rolled when a cop comes over and makes him open up every one to prove it was tobacco. He was .......

This is true. They regretfully mimic genuine gear too. I don't even want to know how many people are running around with the wrong stuff and don't even know it simply because they don't have a real vape shop near, or do the appropriate research.

Funny enough if it weren't for the "wrong stuff" we wouldn't have the stuff we have today. That crowd has been vaping longer than most of us here.

If you offered to let them do a field test, you are then allowing then to search your car, your person, and take your fingerprints (and now blood too) if they want. Because of the potential for abuse, you should never let a cop do something they would need a warrant or probable cause to do.

And unless you have something to hide, no big deal. If you refuse, they have reason to get a warrant based on suspicion. Why go through all that hassle over a vape? Five minute test on the side of the road, or five month court battle? I'll take five minutes.

The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized

A refusal of unreasonable search and seizure is not probable cause in ANY way, shape or form. We do NOT (or rather should not) have to defend ourselves against warrantless search, questioning, etc. That right is already granted to us.

CA vaper here, don't use that other stuff. Not to say that there isn't anyone that does, but it's not as many as you think. I'd probably guess (and of course I don't have stats, but just from people I meet and interact with) that it's less than 5% of the vape community. The rest of us are just trying to quit smoking.

High end mechanicals and rebuildables are popular in CA and it's way too much trouble and cost to try and use these PVs for anything else than what they were designed to do.

I find that even more bloody annoying that other stuff is being made legal, but our right to quit smoking is the biggest booger on the table. Grrr

Yeah, that other stuff being made legal doesn't interfere with the "we can't make money unless you guys are making yourselves sick (or in some cases don't believe us when we say that you should just think that you're sick)" attitude. E-cigs, among other things, pose a problem for that mentality.

Over a Vape.. Or a Cigarette.. or a can of Soda.. This takes you right to the "Why not a Camera in your bathroom" scenario.

Believe me.. I understand.. You are a Law Abiding Individual.. I worked with HLS, DEA, Border Patrol, Texas Rangers, USCG,etc etc.. for 25 months. I had no worries too.. but then, I know what they see and what they look for.. You do not volunteer to let them check something unless they actually arrest you. Talk all you want. Never agree.

As to prints.. LOL They get mine every 6 months and i still would not agree to a test without a warrant!

If a cop pulls you over for your vaping.. You're either in the wrong place at teh wrong time, or your cop is against smoking/tobacco and thinks it's ok to control your life.
 
I was vaping outside a restaurant and a cop asked me about it, so I showed him. He said he was going to buy one. So, I guess thats a good sign. He seemed more curious than he did skeptical.

Not talking about a cop. But I went to my friends the other week, just a day or two after i got my first PV (upgraded from traditional style e-cig), it was later in the evening, but the property manager, and multiple people sitting on their porches asked me, "is that one of those electronic cigarette things?" and i talked to them for about 5-10 min each. The one guy was genuinely interested as his wife has smoked for 25+ years and hes a non smoker. I told him that ive been without cigs for a few months now and dont miss them at all. Told him about the amount of money I have saved not buying a pack or more a day (shes a heavy smoker he said), and compared the price of a pack to the price of an equivalent ammount of e-liquid. Nobody thought it was for other stuff, everyone knew what it was, just hadnt seen one that style, and wanted to ask me about my experiences with it.
