Did anyone kana caught by HiShAm 2nd time?

I don't know but there isn't any clear legislation on possession so it's a grey area. A friend whom is a vaper once brought a PV to the police station & asked his police friend if it's illegal to own it. They checked around and came back saying it's not illegal to own it. But if the case was referred to Hisham I bet they will slap you with a fine and say it's illegal. Now this is hearsay so I can't confirm so please do not flame me. Just interested to know what was stated in the warning letter.

singapore goes on rule that an accused not be double jeparised That is only if he was acquitted on on the 1st time he was charged with the same offence. Receiving a warning letter does not amount to acquittal. You can still be charge for the the same offence n-th number of time if you are found guilty every time.

If not the word recalcitrant would not exist.

Not really recalcitrant is only upon conviction....the guy committs the same offence again.......my 2cents is theoffence is importing the item.......if they send in 2 packages....u still committed one Offence mah.....

Of course entirely up to them.....i am just the common folk who have an opinon with no backing or experience.....so i may be wrong.....very wrong..........

I believe legal and illegal in Sg should be retermed "wanna hantam", "don't wanna hantam... yet".

With the recent Woff!3s W@@ case we see how our justice is mete out. The terms of law and the fine prints are just tools for the gov to use when they decide to let their dogs out. Even if you get slapped with a $500 fine, would you engage a lawyer to argue the terms "possession" or "importation"?

Look at the ban on duty unpaid cigarettes in Sg. At first they allowed 2 packs per person entering Sg. Then later 1 open pack and 1 unopened. Then later 16 sticks in an opened pack. The enforcement keeps changing through the years (lesser leeway for us), but the law was always the same.

Yes, i've read about that case also. And also another 1+ years back. There's an old ecf member who like to boast about being able to vape in non-smoking zone and stuff. And he did that. In the end, he was caught in a pub or restaurant and ended up with a hefty fine. But the 2nd case was more about smoking in a non-smoking area.

For the warning letters no matter the 1st or 2nd letter (you'll receive the 2nd reminder about 6mths later whether you claim it or not), it states illegal to 'import'. But for what i know, people still get warning/fine for using or possessing ecig of any kind. You can probably argue or fight for your case if you are ever caught, but the way sg law works, the chance of success is extremely low. They'll probably just give you a very generic answer, "ecig is banned is sg".

I believe you misinterpreted e term 'recalcitrant'. It means repeating a wayward action.

An analogy that can be used here:
Let's say someone was caught stealing and brought to justice, served his sentence etc. And still steals and got caught again, he is a repeat offender. He is a recalcitrant offender as he didn't learn from his mistakes. So, they slap him with a heavier sentence.

Thus, if 'you' import illegal stuffs and get caught more than once, indeed, 'you' have repeated e same offence. Therefore, 'you' are a recalcitrant offender. And in e note, for those who do not know, states that if 'you' are caught again for e same offence, a heavy fine will be meted out.

Disclaimer: The word 'you' does not imply any said person and is being used here as a general term of reference. Pls do not take it personally.

I beg to differ, it depends on which law the prosecution is charging you with if the case makes it to court

Which means that u can be charge for 1) importing an prohibited item, 2) possessing a poisonous substance without a valid license 3) smoking in a gazetted non-smoking area.

That's why people feel that it is in the 'grey' area. If they do follow the words strictly, making our own pv, getting one locally or vaping 0 nic juices is not against the law in any way.

That guy who got spotted by the man in blue was fined 500 for having it because it is a 'banned item'. The MIB in plain clothes don't even know what it is until they brought that guy to the station for further questioning. He was stealth vaping and the 'smoke' caught their attention. Suspected him of doing some illegal narcotics in the public.

That's what i read tho, maybe the original poster left out some important details like that guy admitted to importing it. We'll only know if we have access to that full official report.

It will be interesting to know also if anyone actually fought for their case in court. The you-know-who seems to change their rules on this over time also, with no official legislation being mentioned. In the very early stages, only those cig look-a-like got targeted. After a period of time, they 'evolved' and those non look-a-like also got targeted (and a lot of people's packages got confiscated left and right). The only person and only case I've heard of a successful retrieval of his package from the authorities is the grandfather of sgvaper. The in charge even told him that the liquids are ok and the pvs shouldn't look like a cig. But now, things are very different. It become from 'imitating a cig' to 'imitating the act of smoking' even the liquids.

P/S : One thing that i want to ask, why call them 'HiShAm'? And apc.gov.sg can't be accessed. Wrong url?

HiShAm. Caps. Notice something..? This is called coding and encrypting here. It's not meant to target e Malays, and no Hishams are hurt in e process. I can even call them wHuSiA. Or sHiShA. Or HeSiA. Ok.. I'll stop now. :p

Yes yes, acceptable norms and mindset changes will change the law on vaping... Not political change in power. :laugh:

Mindsets are hard to change... to layman, smoke from mouth means you smoking and the smoke coming out is harmful. Eg, i walk past a jogger while vaping and he immediately cover his nose with his hands... sigh...

No matter whether imported or not, it is good for everyone to be aware that vaping is against the directions of the authorities - to stamp out smoking alternatives.

Singapore tightens tobacco control measures - Channel NewsAsia

Vaping is still worthwhile tho despite of all the risks involved. Inbetween burning a hole in your wallet or burning a hole in your lungs/ heart, I'm sure many of you would have made the same choice like me. :vapor:

Agree on ur last para......wonderwho was responsible for getting fullfaced helmet approved the other time...??

From what i know, to chang a legislation.....it has to be brought forward by. Ministry in chge of that offence.....in this case HiShAm ...do. Think theywill give themselves more wk......writing paperto change a pre existing law is super shiong......

Looks like status quo for a long long time to come..............:(
