A smoking article in which a flavored aerosol is generated by heat transfer to a flavor bed from the combustion of a heat source is provided. The article generates substantially no sidestream smoke. The transfer of heat from the heat source to the flavor bed is accomplished by convective and radiative heat transfer.

Seems the idea has been in efforts for a long time for the US and the Chinese perfected it. Wonder if Philip Morris has intellectual rights to all the mods on the market. This is just the oldest Patent of a few hundred held by Philip Morris and RJ Renolds

IANAL, but I would think that by specifically stating the heat source involves combustion (as in burning butane or other fuel) that it would not cover electronic PVs. Patent lawyers are some of the most highly paid weasels on the planet though, and mostly because they're good at finding loopholes in points like that. I'm sure they could make a case, but who wins would depend on who has the most money to spend on it.

That is just the oldest one, I found that the idea being around since 1949 was amazing. There are hundreds of them held by the major companies and prototypes have been tried since 1988 using vapors in the US. A normal cigarette consist of on average ~80% tar and related particulate materials and ~20% water, glycerol and nicotine. The product released in 1988 had ~15% tar and 85% water, glycerol and nicotine which reduced 90% of second hand smoke and was delivered via vapor. If a person is using tobacco Absolute isn't tar going to be there from the tobacco?

Did they classify them as drug delivery devices out right? Was that label ever tagged onto the units? That was some of the information I could not find. You have the Premier, the Eclipse, the Next, the Accord and the newest one I can't find it's name again is pictured above and is in testing. Here is a good article.

Seems the big tobacco industry will either help us legalize PV's or give up that road and help prove cases against them to push tobacco sales. Once they are made legal I would suspect that is when they will go around and push the little guys out of business with intellectual property lawsuits for copyright infringement.
