The above is only correct if...

We can not accomplish the above.

And that is why we have to fight to change public opinion.
AND find a way to actually be heard.

And since we probably aren't going to win that fight, I like many of zoidMan's posts.
But I hate myself for doing it.

I've been fighting for over four years to encourage vapers to get involved and fight.
And in the process I have become somewhat disillusioned.

And if we can't change the public opinion, we WILL lose.
It's just a matter of how much we will lose.

Vapers just aren't getting involved enough in this fight as far as I can tell.
But we do continue to make progress nonetheless.

This whole thing is one big cluster.

I hear you DC.

This is the thought process that is going to make e juice cost $12 per ml.

I sincerely hope y'all get what you're asking for.

Put your e juice OUT OF REACH OF CHILDREN

OR

JUST NO LONGER buy FROM THAT VENDOR AND TELL HIM WHY.

Please DON'T invite the .gov in to eff things up for me.
I don't know where you're from but hello kitty hasn't been for kids since it came out
...and why didn't they go after Sanrio for marketing something like this???

(although I will admit to having a 'Hello Kitty' watch... )

I won't turn this Thread to that Topic. But that Doesn't mean that I don't agree with what you Said.

;)

Okay sorry.. Presidents (plural). It has been going on over the last several presidencies. Democrat and Republican. Regardless of politically ideologies, the trend in politics is pass then worry about the details. --- I told my boss to give me a raise and then we will worry what I will do to earn it. :)

I believe the FDA is under the HHS which is a position appointed by the President.

It comes down to a a couple basic reasons...first it catches your eye and makes you more likely to buy it than the plane bottle that you don't see within the plethora of other bottles and secondly its banking on you having nostalgic feelings from when you were younger...that's how I had my first fruit loops vape...IMO the labels and flavors don't mean jack ****...it's just a reason they are using to demonize us...they would find something else if we changed the labels and made the flavors nasty as hell so It doesn't matter to me
We need to change all the labels.
But we need to set up Vaper's Code first.

From now on fruit flavors will have the word "broccoli" in them...
Like "Strawberry Kiwi Broccoli" flavor.

And desert flavors will have the word "cauliflower" in them...
Like "Apple Strudel Cauliflower" flavor.

You see where I'm going with this, right?
Who's on board?!?!

Yay!!!

But they'll just cherry pick incidents and use them for the next phase of restrictions instead of admitting the onus is on them...
Enter Kent C and his arguments for "unintended consequences" of bad legislation.
New legislation is needed to correct the problems engendered by the previous legislation.

Hasn't the FDA pretty much stated, "If it doesn't have any nicotine in it, we can't regulate it as a tobacco product"?

If that's really how things shake down, e-juice companies will be able to continue to offer the exact same products they do now, that we've come to know and love, including the attractive labels, just without the nic.

... Which would raise the question I've been asking for well over a year: "What's in YOUR freezer?"
Here is one person who gets it.
And my freezer has a 10 year supply.

I expect something like PACT will be passed -- it effectively stopped internet sales of cigs and cig rolling tobacco by putting such strict requirements on vendors that most of them didn't want to mess with it.
The PACT Act will probably be amended at some point to include electronic cigarette liquid.
But the states and other local government agencies might do it on their own.

But yeah, I find it hard to see online sales surviving in the end.
Well, unless we can rise up and destroy the lies and the liars, and win over the public.

There isn't a "Hole". It comes down to Does the FDA have Any Legal Authority given to it by Passed Laws by Congress to Regulate a Product that is Not Deemed a Tobacco Product and is Not Sold as a e-Cigarette. And the Answer is NO. They Don't.

Can the FDA Regulate this Product as it is Marketed using Deeming under the FSTPA?

300.JPG

NO. They Can't.
the answer is undeniably yes.
the can regulate tobacco and any tobacco product or any
thing derived from tobacco or a tobacco product.
this means any and all things that mimic, copy, replace, are a facsimile of,and perform
the same function as tobacco or a tobacco product.
what exactly does this leave out and how?

You can't do that. My kids love cauliflower. I do too. Broccoli would be a no go too. Mashed cauliflower is amazing.

I think former President George H.W. Bush would get Behind this as a way to Turn Off kids to e-Liquids.

Actually the question that needed asking was "how much food did you throw out to make enough room in the freezer?"

I threw out some stuff that had been parked in the bottom of my freezer since we moved here, 3+ yrs ago... :D If it didn't get touched in that long a time, it was never gonna be. :D

Oh, and I put my foot down about ice cream containers, too... only ONE if he gets one of those gi-normous Blue Bell buckets... if he goes for sensibly sized Edy's or that one in the yellow cartons, he can have two. NO MORE! I personally couldn't care less if ice cream production ceased yesterday.

The concept of "intended use" may come into play here.
