Deeming regulations aren't law and can't outright ban or make devices illegal only congress can do that. Will they try and ban devices, absolutely and they will lose just as another government agency did when they tried the same thing banning devices used for another activity that was illegal under our laws. Because these devices were not illegal under any law they had no choice but to permit them. It still caused an uproar for a while and some people were even jailed but in the end nothing they could do.

I said in an earlier thread there is an easy way for brand new device to be released every minute of the day and nothing the FDA can do aabout it...they just need to change the name from vaporizer to vv/vw personal flashlight and we'll all be collecting new flashlights.

You are Kinda Right. And a Lot Wrong.

The Deeming Rule Set is a Not a Law. It is a Set of Regulations who's Authority is given by a Law. So Yes, your are Correct in that Part.

But where you are Wrong is that the FDA used a Law that was Never Intended to Include e-Cigarettes and then they Basterdized Deeming so they could pound the Square e-Cigarette Peg into a Round Regulatory Hole.

What the FDA has done with e-Cigarettes is Overreach of the Highest Order. And are using the Ineptness of the almost Non-Existing Oversight Process to Achieve their goals.

Again, you haven't read how the FDA covered this. Flashlight moniker or not, if the intended use is vaping, it's covered by the deeming regulation. Doesn't matter what you label it.

I've read perfectly well how they covered it and it can't be conveyed as they wish to an electronic device that is nothing more than a battery pack on it's own. Now if it is sold in conjunction with a tank or an RDA it would violate their regulations. On it's own they have absolutely no grounds because it doesn't constitute a tobacco product on its own.
