A US appeals court ruled Tuesday that the government cannot block the sale or import of so-called electronic cigarettes under existing laws, in a victory for the industry.The appellate panel upheld a lower court ruling that said the Food and Drug Administration has no authority to halt the sales of the battery-powered nicotine devices if they are not marketed for therapeutic purposes.

They may not be able to ban sales, but I thought I read where they could monitor the sales as they do the regular tobacco products. Does this mean that taxes will be added to the juice products? I was informed that even if the taxes are applied it will only be to the juice, and not the hardware. Does anyone know if this is true?

I don't suppose the hypocrisy of taxing tobacco AND non-tobacco products is lost on anyone. The alleged purpose behind high taxes on tobacco products is to cover the health care costs and discourage people from using them. Taxing a less offensive alternative that actually accomplishes the same stated goal of discouraging use of the offending product? So not cool, but I have no doubt that hypocrisy has ever stopped a politician from doing anything.

Sooner or later the government will get their cut through taxes. That is a given. What we need to worry about now, will states take it upon themselves to ban PV and liquid at the local level. This could become a state by state battle.

I don't think they can legally ban the liquids or pv's at the local level, especially now - unless there's a state or county out there that has actually succeeded in banning tobacco products.

Tobacco products are legal in all 50 states to the best of my knowledge.

What they WILL do is tax them heavily, which is a disgusting abuse of power. Write to your political representatives and make it very clear to them where you stand on the issue.

I posted a thread on this yesterday...
The U.S. Court of Appeals in Washington said the FDA can only regulate e-cigarettes as a tobacco product. The ruling means the government can oversee the marketing of the products, not restrict their sale.
It means the FDA cannot just tell vendors they cannot sell them anymore period. But, being under tobacco laws presents some new challenges/problems. For one, big tobacco could easily step in with their trillions of dollars. Two, recent laws passed prohibit the mailing of tobacco products. There's a few others but these are the big ones. And expect to see some kind of taxation come aboard...

You're right, my mistake. They cannot ban the use, but they can ban where they can be used. I doubt the legal battling is over, but expect to see Philip Morris come out with their own PV in the near future.
