FDA Loses Appeal, Can’t Regulate E-Cigarettes as Drug :party:

Dec. 7 (Bloomberg) -- The U.S. Food and Drug Administration lacks the authority to regulate electronic cigarettes as drugs or devices, an appeals court ruled, upholding a lower-court decision.

The U.S. Court of Appeals in Washington said today the FDA can only regulate e-cigarettes as a tobacco product. The ruling means the government can oversee the marketing of the products, not restrict their sale.

Well here in Canada they go hog wild on tobacco taxes. I'm not sure our universal health care would be possible without the money that comes in from smokers. I would just hate to have to buy pre filled carts at $10 for a 5 pack...

I'll buy black market before I'll be forced to buy pre-filled........without batting an eye. This is good news...FDA .... out!

Courts overrule socialism - shocked. In all honesty, besides this actually providing hope that we "might" not end up a totally socialist country, I am most happy for the "mom and pops" that decided to start an eliquid or pv business. I have enough juice for at least 8 months - but their businesses would have been toast - in one day.

FSUSA, LiteCig, etc. families - great news.
