FDA Loses Appeal, Can’t Regulate E-Cigarettes as Drug

Dec. 7 (Bloomberg) -- The U.S. Food and Drug Administration lacks the authority to regulate electronic cigarettes as drugs or devices, an appeals court ruled, upholding a lower-court decision.

The U.S. Court of Appeals in Washington said today the FDA can only regulate e-cigarettes as a tobacco product. The ruling means the government can oversee the marketing of the products, not restrict their sale.

Well here in Canada they go hog wild on tobacco taxes. I'm not sure our universal health care would be possible without the money that comes in from smokers. I would just hate to have to buy pre filled carts at $10 for a 5 pack...

what this also means is the suppliers are capable of ordering bulk orders from other countries and bring them into the U.S. without customs confiscating them.

This is great news. I wonder if this only applies to hardware or also juices? From what I read it sounds like it's the hardware that is the topic and didn't notice anything that would relate to juices other than pre-filled carts.

Damn this is good news, what alot of folk dont realise is in smaller/poorer countries we dont have an organization like the FDA and the regulations that are passed here depens on what the FDA rulings are, they tend to follow like sheep, so this victory has far reaching effects.

Courts overrule socialism - shocked. In all honesty, besides this actually providing hope that we "might" not end up a totally socialist country, I am most happy for the "mom and pops" that decided to start an eliquid or pv business. I have enough juice for at least 8 months - but their businesses would have been toast - in one day.

Luckily enough for the most part those mom n pop shops have pretty low overhead. Still could be trouble for them if they start widespread selling in corner stores. me personally I like dealing with the small companies that are willing to take a phone call and even throw a freebie in once in a while.

This is great news, but I'm worried about the potential for taxing. I never miss a good opportunity to worry.
