Ya, I hope Matt doesnt mind but anytime anyone asks me what pipe I have I say I have a "Wellman" from epipemods. Sorry I have no patent advice lol, and you wouldnt want it if I did because Im clueless. I just pray that the right decisions are made and that you are successful beyond your wildest dreams!

If you don't get a patent...
The other option is to take your designs on paper as well as finished pipe examples and mail them to yourself. One UPS, one Fedex, and one USPS. Send them (on the same day) overnight or 2 day in those hard to open envelopes/boxes. Date all the paperwork inside and put a note about what you're doing and why. Then send those, signature required, to yourself. When you get them, go online and print out the delivery conformation and tracking history and put that with the UNOPENED packages in a save/secure place. THEN, if anyone ever tries to sue you over your own designs, you have documented, sealed evidence that you had the working, produced designs at least by the date you mailed them to yourself. Chances are, anyone trying to rip you off could not produce any documentation that they had the idea prior to when you mailed them to yourself.

At this point, you are making actual pipes, only they are vaped instead of smoked. You're a pipe-maker. China will never be a pipe-maker. They make product out of plastic or really cheap wood and it won't stand the test of time. That's why they're cheap. And honestly, there is a market for that stuff because not everyone can afford a $200 + pipe. BUT, everyone would prefer to have the nice, customized, hand-made, one-of-a-kind epipemods pipe. So there will always be a market for your pipes regardless of the copies. Plus, as others have stated, the market is moving so fast, someone could theoretically come out with an even better design by the time your patent is finished and you start production. Then think of all the sales you would have lost in the meantime!

I heard in a business/copyright course I took a couple of years ago in college that even if you mail yourself your design/music/idea/product this won't hold up in court even a little. It may be enough to sway someone but not the legal system apparently. I'd google it and see if its even worth the effort but like you said about the cease and desist letters, Matt, it will cost a fortune going after someone.

I should have clarified.

My suggestion of the poor man's copyright was not a suggestion of how to copyright his work. Only a suggestion of something he could do if he started making the product, then had someone ELSE copyright his work. It would be a situation where he would need to defend himself against a charge that he was stealing an idea from someone else when it fact it was his idea all along. It might be better than nothing. :blush:

Yeah it is, but this sort of thing needs the attention of a professional attorney when filing.
I actually got half way through the legal zoom patent process when I built the protopype.
I ended up not filing because the process was far too confusing.
If things aren't filed just right the patent is worthless. Not to mention if I had filed for the proto,
I'd still be waiting another year for an answer (which would have been "not approved"), on a mod that has been
Discontinued for nearly a whole year.

One thing I forgot to mention-> For an additional $600 the attorney does a patent search FIRST to help see if your invention is even patentable.

I may use legal zoom for ND forms and copyrighting/ trade marking EPM.
These processes are far less complicated and typically only require a search.
The copyright and trademarking WILL NOT prevent some one from knocking off my idea.
But it will prevent someone from trying to sell a knock off as an EPM pipe or mod.
Similar to the eGo clones, they are all called eGo.

The fact is that NOBODY can copy the art that Matt produces. You will always know a Wellman/EPM pipe when you see one. I can tell your pipe from the Sun pipes in an instant. So here is a honorary family photo of all my Wellman Pipes. I no longer smoke because of you Matt. You have the love and thanks from my entire family. Thanks again for what you do.

Oh, and in case you read this, you might want to get a lightbox, for fun if anything. I got this one for less than $50. Just wanted to suggest a cheap way to brighten up your photos a bit. They seem dark at times and Im always surprised at how much more amazing they look when I get them home :)

I do have a light box. 6 incandescents (no wait 10!)... I think it has more to do with not knowing the right settings for the camera.
I'm a pipe maker... not a photographer :) I'm learning some new stuff with it though.

That is a NICE collection. I appreciate everyone's encouraging words.
I do think that once my new design is seen everyone will understand a bit better why I'm so concerned.

If you don't go the patent route and get into building the new style equipment whats your timetable looking like? At least one more run for the soon to be "old school" design?

Pretty much either way it goes I plan to have the new model out for Vape Fest Chicago. (2 1/2 months)

I may have a couple other new mods ready by then as well.

There are somewhere between 30-50 pipes that will be released in the next few weeks before the dry spell.
I highly recommend that anyone who can afford one should get one for the collectors value.

Also I may have to suspend the current custom queue.
I hate to do this but I feel it's necessary. The new changes will be worth the extended wait.
I apologize for anyone waiting in the queue... this is why I don't take money up front :)
Also I plan to have 100's (hopefully around 500) new pipes ready upon the release date.
My plan in this is to provide pipes to all the vendors out there that have been waiting for them.
As well as have a FULLY stocked website.
By coming close to meeting the enormous demand for the pipes and strategically placing them around the world,
I hope to have better recognition as the first pipe maker with the new design.

I don't mind that at all Dirq, I still plan to brand my pipes with my signature.
The only reason I haven't done it yet is because that $1000 for the brand and equipment has had to go other places.
I would have liked to have the brand ready for the V2 but with the dry spell coming up,
well funds are going to be too tight.

I would think though that the brand will be the first purchase after the new release.

So the decision has been made.
I will not be patenting the new mod/s.
Instead EPM will be working around the clock to release 100's
of the new mods by Vape Fest at the end of March.

There will be anywhere from 2-4 new unique mods released for Fest.
It all depends on what we are able to get done in the next few months.
I promise that none of these new mods will be eGo attachments :)

More info and even pictures will be released as we get closer to the release dates.
If all goes well the pipes may even be released online shortly before Fest.

Don't worry this thread WILL NOT go dead in the mean time.
Stay tuned for the most up to date info on all of the new creations coming from EPM.

For those who are wondering how EPM (I) plan on doing all of this in a few short months...
EPM has recently made 2 new hires!
My neighbor-> a retired mechanic and Vietnam Veteran.
and another seasoned mechanic and experienced e-pipe vapor.

Also for the USBaux (I decided to change the name a bit, maybe it'll stick who knows)
EPM has purchased a CNC! The CNC is an American made Kit that we will be assembling in the next few weeks.
The CNC will allow us to do a lot more in a shorter time.
You can expect to see some funky stuff with our new robot helper at work.

what is it about these epipemods that make them hit so hard and perfect every time?

I have 2... the Thor and a claro walnut egg...

Is it something in the design... or am I just imagining this?

They really work so well... never had a misfire... in several months...
The pipes hit really hard and they just seem efficient... I seem to change my batteries less...

The only noticeable difference that you could have would be switching from an electronic device->
i.e. eGo, or other tact type or regulated switches
to a Mechanical device->
i.e. GG, Empire, EPM

IMO a mechanical switch will hit harder and conserve battery life far better than any electronic switch.

I'm sure that the pipes looking so damn sexy probably has a little to do with it too :D

I think your market is for art lovers who are vapers. I know that I am saving up for one, only because it is handmade and gorgeous, and someone who seems to be a good person is making it. I am not going to buy the 601 just cause I want a pipe (and it's crap, too, but even if it was good.) I think there are people who feel the same out there and we wouldn't dream of buying one made in the Chinese factory. Unless they could clone Matt and set him to work. It's not the same.
But know this one great idea: you sell to the masses you eat with the classes. You sell to the classes you eat with the masses. Who's to say you don't have 2 lines- your own china plant cranking out the matt1 and yourself cranking out the Matt premiums? Just a thought.

It's been a thought but that is too risky. it may happen in a few years but for right now i'll stick to building a U.S. production team :)
