Comment submitted, 1jx-834n-xn3u, Kristin, thank you for your tireless efforts in our defense. I have been vaping for 2 years and increasingly see the need for united voice. This week I became a CASAA member and want to encourage others to do the same.

Thanks for your excellent posting Smokey Joe! I sincerely appreciate your efforts to raise awareness among the vaping community of the FDA & other related special interest groups efforts to ban or restrict the sale and use of e-juice & possibly e-cig products. Again the great American hypocrisy, in the name of capitalism, free enterprise and the almighty dollar in the hands of those who have most of it have again stepped up to the plate of freedom, to trample on our rights and freedom to vape as we see fit just to protect the interests of competing businesses and moral anti-smoking fanatics!!! I am so dam sick and tired of this stupid, intrusive government that allows the sale and use of cigarettes when everyone now concedes can kill us, causes cancer and a myriad of other related life-threatening diseases. Just like they allow the sale and consumption of alcohol which destroys millions of lives, ruins entire families, poisons our youth and costs this nation billions and billions of dollars every year and on and on and on. The depth and breath of so many negative consequences due to smoking cigarettes and/or consuming alcohol far exceeds any other product(s) consumed by Americans and now they want to pick on the vaping community? Give me a dam break!!

Now, all of the sudden, as a reaction to what is happenning over in Europe with regards to ecigs, the FDA has decided to consider banning e-juice and ecigs? I just don't get it and it pisses me off to no end as a disabled combat Vet who fought for his country, believed in his country and believed his country would do the right thing to protect its citizenry. That's a lot of bull!!! Special interest groups, the tobacco and alcohol industry/lobby have very deep pockets and lot's of political influence in all the right places and they are not afraid to bring these powerful weapons to bare when necessary to protect their interests regardless of who it hurts or kills.

Smoking cigarettes is legal, but cgarettes kill. Thus far there is no empirical scientific evidence out there that proves one way or the other that ecigs, ejuice and the like are bad for those who use it. Where in hell is the justification for banning something we still know so little about? Smoking cigarettes is legal yet smoking weed is illegal when we all know how ......... has certain medicinal properties that actually help those suffering from terminal diseases or undergoing chemotherapy. It's long past the time when ......... should be legalized in America. Yes, ......... actually helps people in many positive ways but still it is illegal where I live. As opposed to alcohol consumption/abuse/alcoholism and the resulting drunk driving statistics where millions of people are either killed, maimed or whose lives have been ruined because of alcohol products. So where does ......... fit in? Where does vaping fit in?

I submit that our once great nation take a really hard look at what they are doing and take a step back from considering the banning any ecig/e-juice products until it can be proven beyond a doubt that it causes cancer and then first ban smoking cigarettes. Even then, as long as smoking remains legal, drinking alcohol remains legal, I say leave ecigs alone! Yes, FDA, by all means do the research. I for one believe it benefits anybody who vapes or is considering vaping to be well-informed about any potential health risks associated with vaping if there are any. So far not one person has proven there are any health risks associated with vaping. Why can't America ban smoking and alcohol consumption? Remember prohibition? Didn't work did it? People like to drink. People like to smoke even though they know the dangerous health risks associated with it. And what does our government do about it? They allow it to be made and sold legally even though it kills people everyday. Now that's American government hypocrisy at its best.

Doesn't the federal government, the FDA and other related agencies have enough on their plate right now rather than sticking their hypocritical noses in where there is no evidence that vaping kills people? I say ban cigarettes and alcohol if you are really that concerned with the health and safety of the general public. Legalize ......... and leave vaping, ecigs and the like alone.
There is plenty of evidence showing how vaping is a very effective way to quit smoking analogs. E-juice has none of the harmful carcinogens in it that tobacco products contain. Nicotene, PG, and some flavoring, that's it.

I do believe there must be stringent quality control standards and certification that e-juice is manufactured properly, is safe and does not contain harmful substances known to cause illness, disease and/or death to those who consume it. We need to protect ourselves because as long as the government allows tobacco products and alcohol products to be manufactured, sold and consumed in this country, you can bet they are not looking out for your health are they? It's the great American hyprocrisy at work all for the almighty dollar.

Happy Vaping Folks,

Don't forget to write, if it matters to you, make it matter to them! Let your voice be heard!!!!

Hi all,

Periodically we ask that our members spend a few minutes doing some campaigning to ensure that e-cigarettes are available to all who need or want them.

Today is such a time.

The FDA has long fought a battle to prevent you from accessing e-cigs. Up to now they've been thwarted by legal decisions and the hard campaigning work done by CASAA and others.

Recently, the FDA held a public hearing (Dec 17 2012) which was attended by members of CASAA, ECF members and public health professionals. The testimony from this will be used as input for a report to Congress, required by the Tobacco Act - in addition, written comments will also be used providing they are received by Jan 16th 2013 - this is where, you, ECF members come in.

Please, take some time to submit your comments, either electronically or by post (ideally both). It cannot be overstated how important these submissions are, and this is your opportunity to make a real difference to the future of vaping in the United States.

CASAA have issued a call to action, which I recommend you read. For convenience sake, I will copy here their suggestions for content as well as details of how to submit your comments.

Submitting

Electronically: Regulations.gov - Choose the "Comment Now!" button at the top.

Please note that you are limited to 2000 characters, so you may want upload a file instead. I suggest you prepare your document in a wordprocessor, and if it runs less than 2000 characters, cut and past into the comment box. If over 2000, save the file and upload it via the "choose file" button on the comments page.

In the "enter information" fields, please enter "individual" for organization, and select "individual consumer" from the category field (it's the last one on the list) - unless you are representing an organization, of course!

By Mail: Please send to
Division of Dockets Management (HFA-305),
Food and Drug Administration,
5630 Fishers Lane,
Rm. 1061,
Rockville,
MD 20852.

Make sure to Identify your written submission comments with the docket number [Docket No. FDA-2012-N-1148]. I suggest using a cover page, as well as a header on each page, and also
mark the Docket No. on the envelope.

Comment Suggestions

1. Describe your history as a smoker: When did you start? How long did you smoke? How much did you smoke?

2. Describe your quitting attempts: How many times did you try to quit? What different products and methods did you try? What did you like and dislike about the products or methods you tried?

3. If you stopped smoking completely some time in the past and experienced problems such as feeling depressed and/or anxious, getting along with others, concentrating, remembering, etc. describe those experiences.

4. Describe the effects switching to e-cigarettes has had on how much you smoke now.

5. Describe the health effects you have experienced as a result of switching to e-cigarettes (and/or snus).

6. Tell the FDA that there should not be any time limit on using NRTs, but that it would be better to raise the amount of nicotine each piece provides than to have people use multiple types of products.

7. Tell the FDA that innovative products such as e-cigarettes should not be made less effective by setting nicotine doses too low.

8. If you use e-liquid (or snus) that has a pleasant flavor added (such as fruit, candy, beverage), tell the FDA that this has helped you and describe how.

9. Urge the FDA to not propose the "deeming" regulation because it would ban e-cigarettes, and would sharply increase the price and reduce accessibility of the products even if FDA exempted e-cigarettes from the most onerous provisions in Chapter IX.

10. Ask the FDA to remove text from its web site that is inaccurate and/or misleading.

· For example, many people believe that e-cigarettes are very likely to cause cancer or poison the user because the FDA “forgot” to mention that the amount of carcinogens detected in liquid are no higher than in pharmaceutical nicotine products such as the patch and gum, and that the only toxin detected was in an amount that has never been shown to endanger health.

· Many people that might have switched to snus, which is much less hazardous to health than smoking, but they were convinced to continue smoking instead by the misleading statement “This product is not a safe alternative to smoking.

Many thanks to Elaine, Kristin and all the other members of CASAA who have done so much to ensure that vapers can continue to use electronic cigarette products. Let's hope the FDA sees sense and realises that ecigs and other harm reduction products are an essential part in the battle against smoking related harm. And let's also hope that your right to choose is not trampled on by a body that is not acting in your best interests.

Please, act now.

• I started smoking at age 16. That was 44 years ago.
• During my mid-twenties I tried to quit. I tried cutting down but the craving was very strong with me. I gave up and smoked throughout my 30’s.
• In 1989 I took part in a university study on the patch. I quit smoking with great effort. I never lost the urge to smoke and I remained uncomfortable at best...often I was quite anxious and depressed. After quitting for only 3 months I was back to smoking.
• By this time my self esteem was always low when I thought about how I was unable to quit. I was reminded of this fact nearly every time I smoked a cigarette. I smoked a pack per day for the entire 40 years that I was a smoker. Twenty times a day, I hated myself. I despaired that I would shorten my life, if not develop a serious disease.
• I tried the patch again. I tried cold turkey. I tried hypnotism. I could not quit.
• I watched as both of my parents were unable to quit smoking. My mother died from lung cancer.
• On February 23, 2009, I received my first e-cig in the mail at noon. After using it all day I tried a real cigarette and could not stand the taste of it.
• I have not smoked since that date: nearly Four Years ago.
• I no longer cough at night. My chronic sinusitis is gone. I do not get bronchitis every winter. I do not get short of breath when exercising.

Restricting of types of delivery systems or requiring low limits of nicotine levels in e-liquid would drastically limit the effectiveness of this product.
The ‘deeming’ regulation should not be applied to e-cigarettes as it would sharply increase the price and reduce accessibility of the products even if e-cigarettes are exempted from the most onerous provisions.

It would be Harmful to the health of many Americans if the FDA erects a barrier to the current “style” of e-cigarette usage. The concerns are about regulations that will have the effect of making e-cigarettes INEFFECTIVE as an alternative to smoking.

Man, I kept forgetting to do it, finally forced myself to make the time to write my response. I'm sure they've had a helluva turnout for this, I just hope they actually read and absorb the comments we put forth

My comment:

I was a cigarette smoker for about 15 years, most of that time in excess of a pack a day. Over the course of that time, I attempted to quit multiple times via several methods: "cold turkey" and different NRT products (specifically nicotine gum, patches and losenges), all of the above both with and without employing the aid of support groups or 1-800 help lines. My attempts to quit were all miserable failures, nothing I tried helped with my cravings and irritability. That is, until I found electronic cigarettes . . .

Upon discovering e-cigs and the vaping community, I found myself completely free of tobacco within a matter of weeks. My senses of smell and taste were noticeably improved after a week or two without a cigarette, my breathing and lung capacity were noticeably better within a month. Even my seasonal respiratory allergies seem to have lessened in severity after several months (with this result continuing for almost two years so far). And best of all I have not once felt compelled to buy another pack of cigarettes, an urge that no method previously available to me was able to even begin to accomplish

My experience and that of thousands of others has directly contradicted what policymakers have been trying to force down our throats for years. It is appalling to me how much outright false or misleading information has been put forth by or on behalf of regulatory agencies such as the FDA, and how much of that info is still readily available on their websites regarding NRT and reduced-harm alternatives. I strongly urge the agency to remove any such statements and endeavor to only provide truthful and transparent facts in future

I also urge the FDA not to propose harsh regulation of reduced-harm alternatives to smoking tobacco (including e-cigs). Any blanket regulations strictly limiting nicotine content to ineffective levels, restricting the use of pleasant flavorings, or restricting the allowable term of use for NRT and reduced-harm products will all severely limit their effectiveness.

Isn't the goal of the FDA to protect the health of the American public? If so, limiting the accessibility or effectiveness of products that are proven safer than smoking is highly counterproductive to that goal. Lives hang in the balance, and I feel mine was saved by e-cigs. Don't remove that and other safer choices from the pool of options currently available to those wishing to improve the quality of their health

Eric Manley,
tobacco-free for 2 years thanks to e-cigs
