Here's my letter back from My Ohio rep sherrod Brown. It seems what I said to him went over his head.


Dear Mr Edison,
Thank you for sharing your views on electronic cigarettes and for taking the time to write about your experiences.

Electronic cigarettes are an alternative to tobacco cigarettes designed to deliver nicotine or other substances in the form of a vapor. They have a rechargeable heating component that warms an internal cartridge containing the nicotine and converts the contents of the cartridge into an inhalable substance.

In September 2010, The Food and Drug Administration (FDA) stated that the production quality of electronic cigarettes is substandard or non-existent in terms of Federal health standards which are in place to protect the public’s well-being. The FDA tested cartridges labeled as containing no nicotine but in fact, did contain nicotine. Additionally, after testing cartridges with the same label, the FDA found drastically different amounts of nicotine in each of the cartridges. Consumers should be able to trust a label and not unknowingly inhale nicotine or higher levels of nicotine as many are when using electronic cigarettes.

Consequently, the FDA sent letters to five electronic cigarette distributors citing violations of the Federal Food, Drug, and Cosmetic Act (FDCA). The FDA has stated that if the Electronic Cigarette Association is willing to cooperate with the Federal Agency, it is possible for the product to receive FDA approval.

I will continue to monitor this situation with your letter in mind. Thank you again for being in touch with me.

I got the exact same response back today...

Sent my letters over a month ago to Brown, Portman, and Boehner. I only got the response from Brown, the other two must be too busy doing something "important."

Forgive my ignorance as I've heard people talking about attempts to ban and regulate but I haven't actually looked into their reasons behind WHY they want to do this.
What are the reason(s) a ban/regulation wants to be implemented?

Control of an addictive drug(that is controlled in tobacco form) that is basically free for anyone to buy and use in any amount?
Worry that people could hurt or poison themselves if they are reckless or unsure of how to handle nicotine?
Fear underage kids are able to purchase this and use it?
Nicotine (from a taxed plant) that cannot be taxed in liquid form (and thus loss of funds)?
Tobacco companies getting their sticky fingers in the cracks of the FDA?

I could see them worrying about people having such a toxic substance in their possession, but hey, in Germany we could not buy BLEACH because it is deemed too dangerous for the general public to use.
I'd like to think everyone that purchases this stuff, with nicotine, doesn't abuse it. I mean, really how could you abuse it? Either way with a cigarette or vapor you're addicted, it just depends on how you are getting it. At least with nicotine in the vapor you can control your amount and taper yourself off. I wouldn't understand why someone would want to go up in nicotine, if thats part of the fear that adds to the suggestion of the ban. /ramble

Basically it seems to boil down to someone high up isn't making the money that they see someone else making in an untapped market.

Going to be writing and mailing in a letter(s).
A good thing to mention is how much health care is spent on people who get ill from cigarette related health problems.

Idk. Better sources could be found.

They are failing to compare e-cigs to real cigs and understanding that many will go back to smoking if the e-cig is banned.

Wait, you mean people will go back to smoking and the reps wouldn't have tobacco companies possibly donate money against their campaigns for supporting a competitive product? I don't see why they would want that to happen. :p
^I hope this isnt the issue, that would be hard to fight.

Hmmm... While we have a pile of seized merchandise the past 6 weeks, I just saw the weirdest thing that made me near mess myself.

Can't give details for obvious reasons but this is the first time I saw a shipment arrive clearly labeled on the manifest "ELECTRONIC CIGARETTES 5000PCS"

I literally yelled out "holy ----!" and the carrier says "customs was there this morning and they looked at it i said 'oh no thats just electronic cigarettes', they said they don't care about those and they took off with some rosetta stones and nfl jerseys i guess were fake"

I am so confused at this point.

I posted in the vendors' private forum about this.. saw a "press release" by an ecig company saying their latest appeal was also rejected (as in, appeal filed AFTER the december ruling) but i found no other source for that info...

To answer your question: YES. I just got a shipment in today that was seized by the FDA in chicago.
