FDA at it again...tell your Representative

I've never been a very 'political' person. For most of my life, I've had no problems with or much knowledge of the "goings-on" of the political world.

But from what I've discovered recently in my adult life, our country is much, much less 'free' then I had thought in the blissful ignorance of my younger years. It was my original understanding that we lived in a democracy, a 'for the people' government, and in this system, people vote on particular subjects, and if majority rules, well, then, majority 'rules'. It would appear that this is no longer the case. I'm not the most intelligent person in the world, far from it. But I know the difference between right and wrong. I also know the difference between 'freedom' and 'tyranny'. It seems to me, that more and more often, the people will say 'Yes!' and the government will still say 'No!'. This 'for your own good', 'protect you from yourself' attitude, at least to me, seems a lot more like a dictatorship than a democracy. How can we call this a free country when we our constantly being told what we can and can not do? These e-cig ban attempts are so petty, so ridiculous, so outrageous, it almost makes me want to leave the country. The FDA approved medication that caused me harm and has most likely shortened my life considerably, and now is trying to ban something that will more than likely allow me to get many of those years back. These are sad times for America, my friends. Truly sad times.

EXACTLY! I have to tell you that your post is exactly how I feel. I've been going through life basically voting for A or B in elections, then pretty much ignoring what government was actually DOING, until I discovered vaping. How did it happen that this "free" society was trying to condemn the only thing that actually made me despise cigarettes after smoking them for 36 years?

I was recently at my town library, and stumbled across this book:

If you really want to know what's wrong with the FDA, and why drugs that are dangerous are released for sale, this book will enlighten you, and it make make you a bit sick, too.

I just finished reading John Stossel's book Give Me a Break: How I Exposed Hucksters, Cheats, and Scam Artists and Became the Scourge of the Liberal Media. I've pretty come to the realization that the Libertarian Party actually matches my own beliefs better than either of our flawed two parties. What is really sad is when I said that at the dinner table the other day, I was collectively laughed at by my 16 year old son, my 18 year old daughter, her boyfriend AND my husband.

In the last six months I have quit smoking, taken up vaping, and become an activist. If enough vapers get involved, maybe we can stop the FDA from doing harm to us, which is what they seem determined to do.

I never do anything proactive for a cause and honestly I do mean never. Not something I am proud of, just being honest. But this issue strikes deep at my personal health and happiness and so I spent my 30 minutes sending out emails and prepping my snail mail letters which went out today. A half hour is all it took....if only half the people on this forum did the same, it could have a huge impact.

Thanks for the info about this. When will they stop trying to kill us just to make a profit. How far has our gov. sunk to let this go on. It deeply saddens me to think how bad things have got, and seem to keep getting worse, no matter which party is in office. Our rights seem to keep getting taken away from us masked in good intentions, to blind us from what they are really doing. Enjoy the internet while you still can, they are working on controlling it as well. The sad thing is, that we the people are so dam stupid, or maybe we just have become so complacent and lazy that we just let them do it. I don't understand it anymore, what happened to us.

Now don't get me wrong, I love America. But the BS has GOT to STOP! VAPE ON my friends! Send your letters! They can have my PV when they pry it from my cold dead hands! The FDA is going too far now! If we ALL take EVERY SINGLE LEGAL ACTION we can, and we do not give up, we can WIN THIS! ALL TOGETHER NOW! SEND THOSE LETTERS NON STOP UNTIL OUR VOICES ARE HEARD!

We cannot count on others to do it for us. They are fighting, but they NEED OUR HELP! It is the responsibility of each and every one of us to FIGHT for OUR RIGHT TO VAPE! Our right to SURVIVE without disease caused by SMOKE! Please, WRITE THOSE LETTERS! And to those that have, THANK YOU SO MUCH for doing your part!

Questions from me just so I'm clear, because I'm not all well versed on the subject.

Am I to understand that the Federal courts have instructed the FDA to regulate electronic cigarettes in accordance with the Tobacco Act [S. 982, the Family Smoking Prevention and Tobacco Control Act]?

If so, take the following into consideration. It is an excerpt from the canned response I received from Senator Kay Bailey Hutchison:

This legislation provides the FDA the authority to regulate tobacco products, marketing, and sales. Tobacco products are subject to the same consumer protections as those applied to other products, including ingredient disclosure, product regulation, and label and advertising approval. The Family Smoking Prevention and Tobacco Control Act also includes provisions, such as a ban on artificially or candy-flavored cigarettes, that would specifically seek to restrict the direct marketing of tobacco products to children and young adults.

What is the basis of the FDA's asserted authority to seize these shipments from China? Furthermore, are "young adults" clearly defined in this legislation?

Just trying to get up to speed here. Help from any legal eagles would be appreciated.
