As the one who convinced Senator Mike Enzi (R-W) to amend the FSPTCA in 2007 to require color graphic warnings on cigarette packs, I'm pleased the FDA decided to not appeal Judge Leon's ruling to the US Supreme Court, as doing so would have jeopardized the statutory requirement that FDA require color graphic warnings on all cigarette packs. By rescinding their unconstitutional warnings, the FDA now must go back to the drawing board and develop new color graphic warnings for cigarette packs.

Amazingly, but not surprisingly, CTFK issued a press release claiming that it is “disappointed” the FDA chose to preserve its legal authority to issue Constitutional color graphic cigarette pack warnings.

I don't understand why anyone (including anyone at FDA) takes CTFK seriously, as they continue urging the FDA to keep losing in court.
