I would have thought that this would have ran it's course by now, but I live in the real world and the FDA is stuck in some kind of funk.

Actually they apparently have a new department head, at least that is what the video mentioned. And he is being more aggressive by the sounds of things all over the place.

Hopefully this will all die down soon and become more reasonable Also the issues with the eCigs hopefully (praying) in our favour.

Thing is, the FDA is right in the General Mills case. General Mills violated long standing FDA regulations by making unsupported health claims. All they had to do was say "may reduce cholesterol by up to ten percent in a month" and "some studdies show that Chereos can reduce cholesterol."

I have some direct experience with this because I used to work for the agency handling Quaker Oats' advertising campaigns. They were always VERY careful to include the correct language and not make definitive claims like General Mills did.

Of course the FDA is correct here. But this logical and correct post is whistling in a dark closet. All many here want to do is rant and vent against the FDA -- even when it's doing its job to uphold standards that protect all consumers.

In the name of "personal choice" or "personal freedom", the anti-FDA posters would allow anyone to sell snake oil with any claim, without any check or balance. Sorry, but those days did exist once, a century ago, and they are relegated to the sorry bin of history.

Exactly, TB. In Canada, products are not allowed to make health claims like this, and that's as it should be. Especially since most of them are innaccurate at best anyway, and certainly don't tell the whole story. The Cheerios claim infuriates me - lowers cholesterol? The cholesterol issue and its relation to CHD etc is far more complex than just 'low cholesterol is good', (ie: particle size? what about trigs? etc) and claims such as this are incredibly misleading and only used to jump on a marketing bandwagon. The FDA moves against this sort of thing for a very good reason (the fact that FDA has its own ridiculous problems/history notwithstanding)

This is all about drawing a line in the sand. If I were to put out an apple cart, and advertise my apples as "eat one of these apples each day, and you will not have scurvy," the FDA would shut me down if I gained enough notariaty to garner their notice.

BUT - I'm advertising my product in a logical way - and not telling any lies.

There have been studies that show eating oat bran lowers cholesterol. GM is using these studies as a basis for their claims.

The biggest difference between the apple cart, the oat bran, and the snake oil salemen? Intent to do harm. If you eat Cheerio's or apples, they aren't going to do you any harm! Irregardless of the "health" claims. THIS is where the FDA is showing its overzealousness....

If we continue down this path, soon there won't be anyone able to preach proper nutrition, (except big pharma) as that will be seen as trying to make health claims.

For one thing, this is not necessarily true. For example, suppose a patient is using Crestor to lower dangerously high levels. Then he sees the Chereos box and thinks "Hey, I pay an arm and a leg for Crestor, but this stuff is dirt cheap and does the same thing!" That's potentially a big problem.

Second, in this case the FDA is not being overzealous. They're enforcing standards that have been in place for decades. The only reason FOX News is hyping this story is that there's a Democrat in office now and that's not anti-FOX News rhetoric. As I said, I worked on the "How Oats Work" campaign for Quaker Oats from 2001 to 2003. A big part of that job was consulting with Quaker Oats' legal department about what they could and couldn't say about the healthy benefits of oats. It was clear back then, just as it is now, that there's not enough evidence available to make the claim that oats DO reduce cholesterol. There are some studies that suggest that they do and that's enough to build a campaign around, but not enough to make a flat out "these things will reduce your cholesterol" claim.

Again, I think it's critical that we choose our battles wisely. This is not a fight we want to get involved in, because we're easily shown to be on the wrong side of it. We need to stick to the e-cigarette debate because we know the FDA is out of line on that subject. If we attack them on every issue that sources like FOX News raise a fuss about, it undermines our credibility and damages our cause IMO.

Wow, come on guys, it was funny. You know, break the tension. Of course the FDA is right, they would not pursue the action, if they were not right. It's just fun to see some of the things that goes on in government, as real as they are, have a little humor in them. If you can't laugh at the government, who can you laugh at.

(as for fox news hyping it up) It was funny, I heard it live when it first aired. I doubt the last thing on the mind of the Fox News producers is "Let's screw with the FDA today." It's only news because it's funny. Man you guys are killing me... :p

You underestimate the number of people who take these kind of FOX News stories as gospel. The rhetorical position was clear: Look what the EVIL and UNREASONABlE Obama administration is going with the FDA.
