Mitch Zeller's endorsement of smokers quitting smoking by switching to e-cigs is nice, but his repeatedly stated zeal and intent to implement the deeming reg (without acknowledging that it would ban >99% of e-cigs and give the e-cig industry to Big tobacco companies) is far more telling.

Notice how Legacy's Robin Koval (and nearly all others who strongly support the deeming regulation) is focussing on regulations that FDA didn't include in the deeming reg and potential FDA regs to ban menthol cigarettes, as doing so makes the FDA's deeming reg appear as a reasonable compromise.

But in response to David Abrams' comment/question about the deeming reg paving the way for Big Tobacco companies to take over the e-cig industry, Mitch said it wasn't his (or FDA's) concern about what company(ies) filed e-cig applications with FDA, but rather that FDA wanted all applications to be based upon scientific evidence.

Legacy was established in 1999 as part of the Master Settlement Agreement (MSA) between the major tobacco companies, 46 US states, the District of Columbia and five US territories. The states requested that a portion of the money they received from the tobacco industry be used to establish and fund an organization primarily dedicated to studying and providing public education about the impact of tobacco in order to reduce its use and associated death and disease.

I'm sure Mitch will do everything in his power to help out his former colleagues at Legacy...
