It's pretty clear that they won't listen to facts. What I want to know is, are they going to fail again like they did in 2009?

I agree they've already made up their minds how they're going to regulate. What's taking them so long is figuring out how to do it so they don't end up in court and lose like the last time. (I'm sure the busiest people at FDA/CTP right now are the attorneys.)

That is exactly what they have been doing. I'm curious if we can file a class action lawsuit over the legislation. I should really look into it.

IMO, too soon to be thinking about lawsuits (except to keep them as an option, depending...), not until we have the rule in hand.

I understand that, but to start roughing out how we would go about getting one together to minimize the time it's going to take to execute may be worth a little time.
