Guys i need help here

So i got me a nice new ecig and i am loving it!!!

In my work i am in a back office away from customers, and i use my electronic regularly.

my HR guy is a real jerk about it even after i have explained to him and the managers on what these things are he insists its "smoking"

i rarely interact with customers, and never use my ecig while doing so, i see no reason why i am not allowed

well he wrote me up today on "smoking" inside the building.

what can i do about this?

i have read threw our companies policy manuals and the only thing they say about smoking is "smoking is not allowed in (companies name) building, warehouse, dock area, around customer entrances, or within proximity to the building according to local law"

If you value your job then I would do as your HR guy says.

Vaping is not worth losing your job over.

Just stealth vape in the bathroom or something.

You have little to no recourse on this matter.

Ask him to "define" smoking.
Can you use Nic gum at work??
Nic patches?
Nic lozenges?
Nic inhalers?
Vaping is just a delivery system--no different than those listed.

That being said:

I have people like that at my factory also.
Some will NEVER agree that it is NOT smoking.

Sorry man, I love vaping, but vaping is NOT the same as nic patches/gums/lozenges. Vaping still puts stuff in the air that your co-workers have to inhale as well.

I'm not saying it's dangerous to others but people will be stiff about this kind of thing no matter how much evidence comes out that it is completely safe.

Some people are even sensitive to smells...

I do NOT push the envelope at work. I vape in the smoking section and maybe sneak a stealth vape in the bathroom now and then if the weather is horrible that day.

It's safe to say that if you value your job you follow the smoking guidelines when you vape...why create a problem?

at this point technically you cant get into any amount of trouble...atleast of course untill they change the company policy handbook to read " no smoking, vaping, or using any electronical device to deliver nicotine, in the building is permitted. :)

Please do not tell him that.

A company can fire you for ANY reason whatsoever.

Hell, they don't even technically need a reason unless you are unionized.

You can and WILL be fired if your HR manager tells you you cannot vape inside and you continue to do so.

He was obviously warned previous to his being written up. The Boss tells ya to do or not do something you obey him. I believe it could've been written up differently and HR seems to be a little clueless as to the wording of this.

#1 tone the language down. I always ask permission on other people's property and if they don't give me permission so be it.

and i dont mean to sound like an entitled jerk but he has got me really frazzled

i have been using this since may and until recently there has been no issues with any coworkers, customers, or anything.

here is the "finer" details

when i first go my electronic ciggarette i showed everyone who worked here what they were and had no objections on using them indoors from my regional manager, my store manager, my manager, and my coworkers, the only person who objected was my HR guy
i explained to him the finer details and still his reply was "I can see it, its smoking and you cannot use it"

my regional manager retired recently and the since then my hr guy has been so far up my ..... well you get the point

this is upsetting me off mainly because this one guy out of 50 coworkers, has made it his mission to not allow me to use this.

And for him to write me up for smoking indoors?? It really rubs me the wrong way.

ha ha im from utah, most people think we are polygamists anyhow so its just been a long running joke because of that, i have used this username for everything and it brings up some interesting comments. Especially from people who cannot read and wonder what a poly..gamists is? "what are you a gamer who plays multiple games or something"

its great fun sometimes.. untill i get called a child molester.... thanks warren... :/

utah is a state where they can fire you for no reason, however my HR guy can just keep writing me up, in this company i dont believe he has the ability to directly fire me, just to annoy me.

It's all good and I can understand why you're upset. HR are generally (please don't attack me HR people) @$#%& types. You could possibly ask for a sit down and have it either reversed or worded differently IF you can come up with something that wouldn't be so harsh in the labeling of your infraction. Not a Union Guy but sometimes there's such a huge need for them such as in this instance.

Sorry pal....if this one dude has the authority to say whether or not you can vape, and has the authority to write you up if you dont follow the rules, then you really don't have an option. I wouldn't push the issue. Enough write ups and you can be seen as a troublemaker and just cause future heartburn for yourself.

I would say to not vape at work at all. I recently opened a post here asking people if they smoke at work (no stealth mode) and 100% of them that said they do vape at work asked for permission first or had someone in the company that allowed them to vape (or even smoke in some cases).

I would suggest you to be careful and do not take the risk of being fired just because of that. Take your time, go to the smoking area and vape there...

I work in a building where all the people have to go downstairs/outside to smoke. I didnt see anyone vaping here yet, but anyway.

Stealth mode works too, just be careful for the following days he can possibly be watching your steps (and puffs :D)

I guess I am blessed to work in a shop (alone for the moment) with a ventilation system designed to change air every 4 minutes!

I also have an office,with windows and a door!

Everybody knows,its my domain.

Even some select bosses come to me to have a cig.

You must have ...... that dude sometimes in the past,you are not telling the whole truth hehehe

Edit: I am hiring :)

    Well I was one of those @#$%^ that owned a business in Utah for many years, and point blank! You played by my rules or there were plenty of guys standing in the unemployment line that would.
    Take my word for it, you would not have been the first person I let go because they thought they had rights.
    Your rights as an employee are spelled out by the NLRB, and state law. Everything else is at the discretion of your employer.
