It finally happened...

Historic anti-smoking vote to give FDA new power - Yahoo! News

One interesting quote on the article though:
"Thursday's legislation gives the FDA power to evaluate the contents of tobacco products and to order changes or bans on those that are a danger to public health. The agency could limit nicotine yields but not ban nicotine or cigarettes"...

Unfortunately, no surprise, since it's "for the children." (And Phillip-Morris, but let's not mention that.)

Once it's official, imho it's grounds for doing away with all smoking bans. After all, it's FDA approved. It'll never happen (the doing away with smoking bans) but it is a bit hypocritical to have it FDA approved yet banned from being used in certain areas. Not to mention the smokers that have been blocked from being able to adopt simply because they smoke. Not only were they engaging in a legal activity but now they'll be engaging in an FDA approved activity.

Again, that's why this is bad legislation. If the FDA holds to its core directive, they have no choice but to ban all smoking. The science shows it's dangerous/deadly. If they allow the sale of tobacco products, they compromise everything else. If they can approve a smoking product that has been shown to kill people, what stops them from approving other drugs that have been shown to kill people? Nothing. This bill, assuming the FDA doesn't throw a blanket ban on all smoking, renders the agency ineffective, untrustworthy and ultimately irrelevant.

But.... this bill still swings many ways. Take a look at the USA Today summary of the bill - (I can't post links yet )

They really sum it up, though still left with many gray areas it seems that according to the article they can't touch e-cigarettes. Really, it specifics only tobacco products, and is e-cigarette a tobacco product? No, it's not. We also know that tobacco companies chemically modify the nicotine to make it more addictive, they are just so much worse on many levels.

E-Cigs are in a grey area - are they tobacco? Don't know. Are they a drug-delivery device? Don't know.

Unfortunately, with the passage of the monster it no longer matters. E-Cigs, no matter what their classification now, will be under the thumb of the FDA.

What we need is a new classification for clean recreational nicotine use - long term, not just the short term NRT's pushed by Big Pharma. Right now, that new classification doesn't exist - and the PTB keep trying to cram our PV's into an established classification that doesn't fit.

Until we get THAT settled, the FDA will halt importations. Period. How fast? Dunno. It depends on how fast the legislation develops.
