Hoping they are only looking at possible budget inclusions and Waste trimming. The Cole Bishop Amendment has no negative Budgetary effect on the agricultural bill :D
It's so confusing, reading the press release that it's passed the senate committee, then (??wth??) what are they doing on Thurs. with it?? I agree with you, I don't think we know everything yet, and like I've said, I know what I heard during the broadcast, I just didn't get to hear all of it...

I mean, it clearly says Thurs., 10:30 a.m., right...or am I just bat :censored: crazy?? :laugh:

Reading this kind of thing gives me brain block, but I see on page 5 the FDA got called out, mildly, on some conflict of interest violations. (gasp!) Then, on page 69, it is recommended "that the FDA consider the benefits of harm reduction as part of evaluations under the Deeming regulations for tobacco products". Also, pages 85 and 86 show several section numbers where "language is included regarding FDA". I know, I'm experiencing wishful thinking, but don't bust my bubble for a couple of hours, ok?

Confession: I just searched for FDA within the pdf.

No it's not the same. H.R. 2058 is a bill that Tom Cole introduced in the House last year(2015) that would change the grandfather date from 2/15/2007 to the effective date of the "Deeming Rule".

His bi-partisan amendment to the 2017 appropriations bill(introduced this year) would do the same thing, but also has a few other provisions. I'm guessing that he believes the added provisions are needed to get it passed by the Senate.

"In addition to changing the grandfather date for deemed products, the amendment also includes language that will:
  • Require FDA to begin rulemaking to establish a product standard for e-vapor product batteries within 1 year of the effective date of the Deeming Regulation, and publish a final product standard for e-vapor product batteries within 2 years of the effective date of the Deeming Regulation.
  • Cause an e-vapor product to be considered misbranded under the FDCA if it is advertised in a newspaper, magazine, periodical, or any other publication other than an adult publication (i.e., a publication with 15% or less of its readership from readers younger than 18 years of age, and read by fewer than 2 million persons under 18 years of age).
  • Require retailers to sell e-vapor products in direct face-to-face exchanges without the use of any electronic or mechanical devices, such as a vending machine. This provision contains an exemption for mail-order sales (i.e., internet), and allows the use of vending machines or self-service displays if the machine or display is located in a facility where the retailer can ensure no persons under the age of 18 would be permitted to enter (i.e., adult-only facilities).
  • Require publication, within 1 year of the effective date of the Deeming Regulation, a regulation that would require e-vapor products to be labeled with the phrases "Keep Out of Reach of Children," and "Underage Sale Prohibited," as well as feature an accurate statement of the nicotine content of the product.
  • Requires retailers (e.g., vape shops) to register their establishment with FDA unless such retailer has already registered under any state or federal law."
Do you happen to have the bill number on this one? I can look it up but I thought if you or someone else had it would be easier than navigating the Leg. website. Just sent letters to Adam Kinzinger a sponsor of HR2058 and to Bobby Rush. Durbin and Kirk...Let's not go there. Ok. Lets not. Ah come on let's try to convince them.. no, no lets not. Ah come on... a little tr....I SAID NO. Jeesh
I am SO angry. My credit card is on fire from all these purchases. But I will not give up. One big problem with these politicians is that they are so ignorant on this issue. I can't believe the hypocrisy..."Nicotine is a carcinogen and causes heart disease", etc.. BUT go ahead, chew 24 mg of nicotine gum per day for the rest of your life. It's OK. Smother yourself with nicotine patches.... It's safe. .....Go insane from a FDA approved wacko drug.... WTH.

Earlier today, the meeting must have started late, as I had only missed the opening of the meeting, the first couple minutes...so, there was nothing mentioned about the amendment.

Now, here is where an extra pair of ears would have really helped me out earlier today, what he stated was, "The bill will be reported, "subject" to amendment, to the full committee."
That's what will be held this coming Thurs., the meeting with the "full" committee, to mark up the appropriations bill.
...I think the stress of all this is really getting to me because I would have SWORN to you all, on my LIFE that I heard what I posted earlier. So, my most humble apologies if I gave anyone a fright.

I'm still concerned that it wasn't mentioned, but I don't know how all this works, and it's entirely possible that the subcommittee doesn't make the decisions regarding any amendments that are added to the appropriations bills...hence, the "full" committee meeting Thurs. - I don't know, maybe someone else here does.

I just feel sick about what I reported earlier. I guess I just keep expecting nothing but bad news with this, and what he said, and what I interpreted, were two very different things. :(
