OK I just read a thread saying there was some confusion about IP and the resale of these for profit.... I'm not sure I even want to crack open that can of worms. I'm gonna have to keep digging.
Which thread? I've seen that before, but I was thinking it was the Scubagen tanks rather than the Genesis. I'm sure you can get around that either by making the build plans available (similar to making the source code available for GPL-licensed software) or by making a minor modification. Zen~ apparently gets away with it with his Z-attys. How is a Z-atty not a Genesis?
The most important components, a stainless steel mesh wick wrapped with kanthal, are public domain and are indeed created by the end user. The rest is just details that can be changed and rearranged if necessary -- a modular top cap that can be plugged and unplugged for needle-less filling, or a Pyrex tank instead of plastic (which was ostensibly already the plan anyway).
The intent behind the restriction, if I recall correctly, was to prevent a vendor from profiteering, from patenting and locking customers into something proprietary (like the Apex Alpha's feeding system). That's what the inventor wanted to avoid. You, on the other hand, will not prevent a single person or company from making his own variant. If you wouldn't care to link that thread where you read that, I'll find you a solution.
You won't be profiteering. You'll be supplying the demand.
