So they can't ban eliquid because they can't ban an entire category.
I'm not sure if they can ban eliquid, but I do know they can establish limits on the nicotine content.
The only restriction they have, that I know of, is that they can not reduce the nicotine content to zero.

And they can't ban flavoring because they aren't cigarettes.
Flavored Tobacco

On September 22, 2009 a ban on cigarettes containing certain characterizing flavors went into effect. The ban, authorized by the new Family Smoking Prevention and Tobacco Control Act, is part of a national effort by FDA to reduce smoking in America.

When the FDA issues their deeming regulations, they could extend the flavor ban to whatever tobacco products they want.
At least that is my understanding.

That's a regulation limiting the size bottle of soda you can buy. It's not a ban. Although it's a perfect example of the types of things they can and can't do.

didn't they ban the sale of sodas over 32 oz? ban/regulation, either way they are trying to control us. I'm an OLD woman, Please, leave me alone!

This should clarify things quite a bit...
Regulation of E-Cigarettes and Other Tobacco Products

It isn't very long, at it goes straight to the point.

Looks to me after reading that they have already made up their collective minds what they are going to do in April.
Since they havent offically made the e-cig a tobacco product they will do that. And then comes chapter IX.

Hopefull the petition will get done and enought people can get a voice to fight.

well if we reasonably assume that they (FDA) cannot do much about wool - kanthal wire - batteries and chargers and SS mesh without irritating every granny, electrical engineer, in the country - that leaves the nic jiuce only.

Well - it's a tobacco product - so we tax it = more $ - well ok to a point. But a 4mg level? lol

why that?

i like to vape my gear at 18mg so my question is: can i take a load of this 4mg plain old stuff and concentrate it in some way back to say 16 or 20?

The reason i ask is because i use 36 mg now but just cut it in half - cos it's easy!

sent from my Cray XK7 in a bit of downtime

At the very least I expect them to make juice containers list the ingredients on the packaging. That may or may not include nutritional information. They did that a few years ago with any product that people ingest/inhale so I don't really see juice as being any different in that aspect. That will raise the cost for the manufacturers and that cost will more than likely be passed to the consumer.

Outside of that we'll have to wait and see I guess.

Yeah well it would be nice if they would ever get labeling on food RIGHT

I'm not an Expert in any of this by any means.

But I thought that the TTB was the Agency who Enforces Tobacco Regulations. Like the way a Police Officer enforces Laws and Codes.

Up til I started vaping I mistakenly believed tobacco was under the ATF (The Bureau of Alcohol, Tobacco, Firearms and Explosives)

not really cause that would effect patches gum and lozenges and BD are also a good friend to the government

The government most certainly can ban the sale of extracted nicotine to the general public. And that in no way effects the manufacturing of patches and gum by Pharmaceutical Companies. There are many chemicals used in the production of drugs that are not available for sale to unregistered companies, especially anonymously over the internet. E-liquid suppliers could become registered and approved to purchase nicotine, and they would probably have to provide documentation on the sale of it in relation to the amount of finished product they sold.
