Thank you for contacting me regarding your concerns with the Food and Drug Administration (FDA) ban of electronic cigarettes. I appreciate hearing from you.
In July 2009, the FDA issued a press release discouraging the use of electronic cigarettes and repeated concerns that electronic cigarettes may be marketed to young people and lack appropriate health warnings. In September 2010, the FDA announced that it would begin regulating e-cigarettes because they comprise both a drug and a drug delivery device. Due to this drug delivery device classification, they are subject to market approval prior to sale under the Food, Drug, and Cosmetic Act.
I support efforts that would require FDA regulated facilities to conduct an analysis of product safety hazards and implement programs to ensure consumers are aware of potential risks. However, it is also very important to ensure that these systems do not overly burden business with needless mandates. No legislation regarding electronic cigarettes has been introduced in the 112th Congress. Should pertinent legislation come to the house floor for a vote I will keep your thoughts in mind.
