If I was going to steal a name it would be Planet of the Vapes that is the coolest name I seen :)

But you have to think about this as if it was YOU!
Say you was the one that built from the ground up and everything else that comes with starting a New Business, and some one comes along and steals your name? How would you feel? And wonder if they run that name into the ground?

NiNi, I'm with you, I think this was a conscious effort to piggyback off of someone else's success. Either that or they are incredibly stupid and didn't do their homework before opening their store.

Maybe I read it wrong but their facebook profile states they have rights to both names Alice in Vaporland and AiV in the state of Texas. I asked them if they were going to carry AiV juices, but they never gave me an answer to that question. Just said there was no affiliation. Either way, pretty much all of the B&Ms here in El Paso are way overpriced, so I just stick to the internet. I am pretty much a shut-in vaper anyway.:vapor:

They can probably legally get away with it but it strikes me as extremely shortsighted if they plan to have much of an internet presence or expand their operation to include more advanced merchandise.

I mean, there's an instant alienation factor built in for any potential customers that might have used the internet to check out vaping and supplies. They're crippling themselves right from the beginning and creating a limit to how far their reach will extend. I'd never be that dim in something as serious as a B&M business.

If they're really that clueless and didn't know about the other AiV, I can't imagine how much success they'd have, anyway. It would mean they'd have done very little research on what is already out there. As I said earlier in this thread, Alice in Vapeland comes up quickly in a search and if they weren't even searching their own potential name, how bright are they?

Trademarks don't go by state. Alice In Vapeland owns the AIV trademark- in the US. They need to have their attorney send the impostor a cease and desist letter.

Well I am now the proud owner of the impostors name here in my state....4 domain names they should have grabbed and a FB page that differs from the one the own by 1 letter.....shall I use this internet presence to educate Vapers....or punish the impostors ? opinions ?

unless you have deep pockets to defend domain purchases ... not worth the time to cybersquat domains.

Any time someone comes up with a name for a new business, the first thing they should do is type in into google to see what pops up. If they would have typed 'Alice n Vaporland' in google, then they would have seen results popping up for 'Alice in Vapeland'. So I don't buy it that they never heard of it. Does it bother me that a B&M is using a similar name? No. However, I am having a hard time believing they have never heard of it.

After reading this thread, and then their posts on FB, I just can't believe them when they say that they didn't know.

Also, I'm pretty sure this FB post by them kind of says a lot about them as a company...
