Is e liquid legal for retail sale?

I was at a tobacco store that I bought my starter kit from and was trying out a new atty. I pulled out a little bottle of juice and topped off my cart and he asked where I bought the juice. He said that he had been losing business because after the initial sale his customers were going online to get juice rather than buying carts. I asked why he didn't sell juice he said he would but couldn't. He said his supplier of SmokeStik and SE stuff said that liquid could not be sold because it did not have an FDA stamp, but none of his carts have that stamp either. So is it legal to sell retail? If not what makes internet sales different?

Look on a package of bacon the next time you are at the grocery store. You will not find an FDA approval on Bacon. The FDA DOES NOT consider "Bacon" a "Food".........they do call it a "Food Additive" . WHY? Because Bacon has NO nutritional value.....seeing as it is mainly fat. That fat can be rendered and used to lend flavor to other foods.

But HEY!!!!.......I LOVE BACON, so I keep on eating it. Like there won't ever be another pig on the planet.

I'd love to know if anyone has any info on New Mexico regulation, if there is any.

To date, no state has passed any laws regarding selling liquid. I beg of you, please do NOT contact state officials to ask this question. People who have asked this question in the past have ended up drawing unwanted attention to the products. Something that was not illegal became illegal (in terms of public health regulations) because someone just couldn't live with the adage:

It's easier to get forgiveness than permission.

Many of the folks running state health departments are deeply ensconsed with the anti-smoker movement, and the anti-smoker movement wants e-cigarettes to be banned.

Yes, "anti-smoker" was a conscious choice of words. I have no problem with people who are anti-smoking, but those who would rather see smokers dead than using safer alterantives are anti-smoker in my book.
