The deeming regulation will not be proposed this month (as FDA previously claimed), I doubt if it will be proposed during the next several months, and I'm still working to prevent the FDA from ever proposing the regulation because it would threaten (instead of benefit) consumer and public health.

Please note that this is the third time in three years that FDA has missed its stated date for proposing the deeming regulation.

The OMB did announce approval of FDA's ICR for HPHC's in tobacco products this week

Now the FDA will publish a Notice of Proposed Rulemaking (NPRM) in the Federal register (probably pretty soon). After that, there probably be a 60 day comment period. I intend to comment and request that the tobacco companies be required to test and report the levels of polonium-210 in their cigarettes. This is what causes the majority of the radiation exposure to smokers from cigarettes.
