Legal status of homemade e-juice?

So it has been established that the FDA could regulate e-liquid and the sale of it in the US, but not the hardware such as batteries and atomizers.

Would the FDA regulation be against the selling of e-liquid, or the possession? The nicotine is the only controlled substance found in the liquid, therefor anything that's homemade would be fine so long as you're over 18, correct?

Sorry, before moving on to your main point, can we just deal with that rather bold statement: where have you got that idea from? They are deeming it a drug delivery device atm.... nothing has been settled and the court case is ongoing.

It is my understanding that the FDA considers both the liquid and the hardware as new drug devices. It would be very easy to stock up on batteries, atomizers, etc,,, As far As the liquid goes, you can purchase pharmaceutical grade nicotine, USP propylene glycol and other ingredients to make your own liquid. The handling of liquid nicotine is very dangerous though and must be done with full protective garments worn including gloves, mask, etc,,, It is not a practice I would recommend for anyone to attempt at home who does not have full knowledge of what they are doing. I would simply stock up now on everything now for at least a year and that way you won't have to worry about anything. If everyone who vaped now stocked up for 1-2 years, who cares what the lame FDA's possition is??

I understand what you're getting at, but it was called "juice" because liquid formulas intended to be used in vaporizers to create a mist that creates the illusion of smoke has been called "juice" for 30 years.

If all of the ingredients can be purchased here in the USA legally, is there someone here in the states that is actually making it? I myself do not want to mess with trying to handling something like liquid nicotine whether I can buy it or not. It only takes one mistake.
I really don't like calling it juice either, e-liquid works for me......

From my understanding, any regulation for both devices and e-liquid will cover importing for the purposes of selling, not for personal use.

It won't be established if buying hardware to make your own PVs will be ok or not until we see how the regulation is worded.

But homemade for personal use doesn't seem to be the FDAs concern - only retail.

that is not true smoke juice dosnt say " drug user" it says fog machine to most folks . has been called that for years a lot of smoke juice ie pg suppliers ie companies or people that sell in bulk. when my nephew 12 years old asked me what is that stuff you put in that thing of yours i told him smoke juice and he said ohhhhh!!! the stuff they use to make fog in haunted houses and use at parties... i said yes and he knew what it was and hes 12. when a police man asked me how does it work he knew what i was talking about then in reference to drugs he said its like a vaporizer?? drug users use vaporizers for thc i learned that from a police officer friend of mine

No, he meant they use vaporizers for "cleaner" smoking of tobacco or medical cannibus.

What we are using are "low temperature personal vaporizers" that don't really have a lot in common with the vaporizers used for tobacco or marijuana because we aren't vaporizing whole tobacco but instead using fog juice that vaporizes at a much lower temperature than tobacco. Vaporizing the raw materials creates smoke without combustion significantly reducing tars and irritants making it safer for long term use.

Much different device, but there are e-cig-like devices that looks suspiciously like a rebranded 901 and a 401 (though they claim it's re-engineered) on the market that uses their own special formula, but contains no plant material. They are legal for sale for medical marijuana patients in California. Many have tried to create a liquid that can work in our devices to no avail, which is good for us in case they try to start using that argument.

What proof do you have to back this up? I have heard nothing about any regulation of e-liquid. This is certainly a very strong claim to make without posting your source.

Well I know that Nicotine itself is a regulated substance. You may want to check with your local laws concerning storage of hazardous materials. I however do not know where that line is drawn. It appears that the levels of Nicotine in our our E-Juice (yes I call it juice, and this thread is not on the topic of proper or proposed vernacular) does not raise the eyebrows of Homeland Security. Now if one was to attempt to order pure Nicotine (>95% pure)from a chemical retailer, expect to be noticed by Government Agencies you probably do not want noticing you.

Lastly if you are attempting to purify or handle highly pure Nicotine, take haz-mat precautions. Nicotine is highly poisonous, and readily absorbed through the skin. Even if you are just mixing your own flavors from 36mg/ml unflavored, I would still recommend some latex gloves or such. Its better to err on the side of safety.
