Thank you for writing me to express your opposition to increasing taxes on tobacco products in order to fully fund the Individuals with Disabilities Education Act (IDEA). I appreciate the time you took to write and welcome the opportunity to respond.
As you know, when Congress enacted IDEA in 1975, it authorized the Federal Government to contribute up to 40 percent of the cost associated with educating students with disabilities. This commitment was to ensure that the nearly six million students with special needs receive the same quality of education as their peers without overburdening local school districts. To date, this commitment has never been fully funded.

On July 21, 2011, Senator Tom Harkin (D-IA) introduced the "IDEA Full Funding Act" (S. 1403), which would fulfill the commitment to fully fund IDEA through Fiscal Year 2021. Funding for the program would come from a tax increase on tobacco products, specifically cigarettes, cigars, roll-your-own tobacco, smokeless tobacco, and other tobacco items as defined by the Family Smoking Prevention and Tobacco Control Act (FSPTCA; Public Law 111-31).

Currently, items such as dissolvable tobacco and electronic cigarettes do not fall under FSPTCA's definition of a tobacco product and would not be taxed under S. 1403. However, on July 7, 2011, the Federal Drug Administration (FDA) released a notice that it plans to issue a new rule soon, which would deem that all products which meet the broader, statutory definition of a tobacco product under the Federal Food, Drug, and Cosmetic Act, would also be subject to the jurisdiction of FSPTCA. Should this proposed rule be issued and finalized, dissolvablesand electronic cigarettes would be taxed under S. 1403.

S. 1403 is currently pending in the Senate Committee on Finance. While I understand your opposition to increasing the tax on tobacco products contained within the bill, I am concerned that school districts may be overburdened by the costs of special education. As states cut back on education budgets, local school districts have been forced to cut some of their services or raise taxes to pay for the special education services they are mandated to provide. Please be assured that I appreciate hearing your opposition to S. 1403 and will keep it in mind should this bill come to the Senate floor for consideration.

I actually would like to hear what Steve has to say about this, cause this is bull...., taxing something that is CLEARLY stated as NOBACCO. This will cause a huge outrage on the board's if they start taxing electronic cigarettes.

Now some companies might eat the taxes and not charge us, but I highly doubt it, and if they start taxing us, lets say bumping the bottle of juice upto 15 bucks, that is not too bad, I can adjust my buying habbits to suit my needs. But if it gets bumped upto 20, that would not be good at all for us.

Now, they mentioned SCHOOL tax for the special need kids, so why do they not raise... Oh idk, something more school related? Like... Hmm... SCHOOL TAX?!? Wouldn't that make more sense?

Your senator (not surprisingly Ms Feinstein) believes that taxing a small segment of the population to benefit another segment is the Right Thing to do. She is TERRIBLY wrong! Either tax everyone, or do what many normal citizens are doing: CUT BACK on spending. She needs to be voted OUT!

Well.........it's not that plant. Let me lay this out in a way that is easy to follow..

This proposed bill like 100's of other is in it's earliest of infancy stage.

If you want to contact a member of congress, then contact any those (D) on the committee. After all the (R) will instantly shoot down anything to do with taxes...especially taxes related to Big Tobacco with an upcoming election year.

Now...this proposed bill has been around a long time....it's nothing new and like so many other bills it has died many deaths before ever reaching a vote.

"Your Senator" .....wow..she isn't even on the committee! Amazing...and this is why we have the politicians Americans so rightly deserve! Uninformed, misinformed, ill-informed, yet never never short of an opinion. The IDEA Act is already law, it just has never been fully funded.

Then amendments to the act were passed in 1997 under a (R) controlled house.

At this stage anybody worried about this is simply worrying about a whole lot of nothing.

Blind partisanship is exactly that.....blind. :glare:

So very true! The odds are against it. I was looking for information on how many senators might be smokers or ex-smokers but haven't found it. I did find this unscientific city-data survey of 75 responses and results I didn't quite expect.

I lean politically left and I currently smoke or used to smoke 23 30.67%
I lean politically right and I currently smoke or used to smoke 25 33.33%
I lean politically left and I don't smoke and never have smoked 13 17.33%
I lean politically right and I don't smoke and never have smoked 14 18.67%

Man would I like to reply on that letter, I would tell the fine Senator that he and his other constituents need to find other ways to find funding sources for educational purposes besides just counting on and beating up on tobacco/Nicotine users. Would love to know what his favorite pass time is and wonder how he would feel if they raised the taxes on his world, Never happen of course.

all i am going to say is she will pass away before she retires .She and ms barbra boxer are notorious here in cali with a long reputation and i cant say what kind of reputation to all but the most liberal voters .She could care less about the moderates .I went on a rant on facebook to someone today and just cant waste my breath or piss anyone else off today :) ..the liberals of nothern cali wont ever vote her out .

And how do they expect to tax someone that uses 0% nicotine on the ejuice? is like paying tabacco taxes for food.

How this in anyway ends up as a stump opportunity to flame Sen. Feinstein makes no sense. The letter itself is a standard form letter, informative about the proposed amendment, thankful, and takes no stance one way or the other. She doesn't sit on the Finance Committee nor is she even a Co-Sponsor.

S.1403 isn't even scheduled for this congressional session. As well a few seats on the Finance Committee will be vacant due to retirement and several others are coming up for re-election in 2012. This only increases the overwhelming odds that this will never pass committee let alone see light of day in the House or Senate.

I agree...form letter...like the dozens I have received over the years :p Good thing I didn't take it personally, right? I could have become quite depressed over their responses :lol: I would get the same letter from my senator...a very conservative republican...saying the same "nothing" :( Like SD said, it's a long way from reality...and we can present a very unified front when our "juices" get in an uproar ;) uh...so to speak :p

+1000 to Snowdragon for actually understanding the function and workings of our government, and being a voice of reason.

I think that sometimes people are a little ridiculous in expecting a personal response filled with sympathy and emotion from a politician who has a lot on his or her plate. I'm sorry, but e-cigs are probably at the bottom of a Senator's list of priorities. This is not to say that I disagree with taking action and writing to your representatives, but the usual pissy reaction that comes with getting a "form" letter is slightly narcissistic. We're talking about a luxury item, that I agree has its benefits, but at the end of the day, is NOT a necessity. What's important to you, may not be the most important thing in the larger picture of society.

I know I'm in the minority, but I think that taxes on things like alcohol, cigarettes, and yes----even e-cigs, to fund something like IDEA is a good thing. That's my personal belief, and it's an ideological belief, so it's certainly up for debate and open to criticism. Lord knows that's the debate the whole country is having now.
