The synthetic nicotine is not tested for human consumption. Most natural nicotine is extracted from tobacco and purified, then mixed with either PG OR VG to keep it at safe limits.
I had not heard that the FDA did not consider ejuice a tobacco product. Do you have a link for that?

I don't think it is, but I don't get money from tobacco product taxes. :p

There are no products on the market, either NRT or e-cig, that use synthetic nicotine as far as we know.
Synthetic nicotine is cost prohibitive compared to extracting from tobacco.

Sorry, I have to correct this...

The FDA case ruled that electronic cigarettes are not a drug delivery device.
But Judge Leon suggested to the FDA that they could regulate e-cigs as a tobacco product under the FSPTCA.

And this is exactly what the FDA has stated an intent to do.
And when they issue their upcoming "deeming regulations" we will find out exactly HOW they intend to do so.

But at this time, until those regulations are proposed, commented on by the public, and finalized, they are neither a drug delivery system nor a tobacco product.
But it is almost a certainty that they soon will be a tobacco product by law.

Hello!

Does e-juice contain tobacco or is it a synthetic nicotine product NOT containing tobacco? I know this affects the ability for resale in WI and trying to get this clarified.

Just so you know, there are currently no laws regarding the sale of e-cigarettes in Wisconsin. If you are concerned that e-liquid contains tobacco leaf and would be considered a tobacco product requiring a tobacco sales license then, no, it doesn't. There are several e-cigarette stores in Wisconsin and a major e-liquid company, Johnson Creek (which supplies blu e-cigs its liquids), is also located here. :)

If I was a bettin' man (and of course, I am), I'm laying 8:5 odds that FDA lets October come and go with no "deeming."

It's been two and a half years since the DC Circuit Court of Appeals ruling, and they've been running their yaps about "deeming" almost since day one. They're in a conundrum, and they know it.

I think that while FDA vaccilates and tries to figure out what they're gonna do, we need to press hard.
