are they going to ban gum and the patch to, it is nicotine in that gum and those patches and like they said nicotine is addictive and they don't want employees that are addicts right???
The gum and patch has already been included in cases of failed drug tests. As long as they detect nicotine they can fire you. Here is a Scott's case I heard about years ago

They do it under the guise of looking out for there employees health and safety.
notice this section:
"Scotts has no policies compelling employees to abstain from other legal but unhealthy
practices, including obesity, consumption of alcohol, failure to exercise, skydiving,
excessive television viewing, eating processed sugars, owning dangerous pets, flying
private aircraft, mountain climbing, downhill ski racing, single-handed sailing, or
spreading toxic chemicals on lawns."
Notice the items they list? Well thats because they are all items that various companies use to enforce similar policies. Its is nothing more then controlling people and taking away there rights by companies and backed by the government. And yes many companies with fire you for not exercising or being overweight. Several Hooters girls that worked down the street from me got fired for gaining a few pounds since they were hired and not loosing it fast enough.
Oh and yes these cases have gone to trial and they all lost
