Philip Morris Claims They have Trademark rights on the word ”cowboy” and also any western imagery.
cowboy hat , a man on a horse really ?
This seems very ridiculous to me.

I don't see how they can win when so many companies in other5 industries have used it and phillip morris not said a word but we'll see.

They should have changed the name to "tobacco flavor the A-holes Make." Everyone would know what it was.

Well the thing is that there are vendors (like the one I order from) that offer marlboro flavor, Camel flavor, Winston and so on. Now so far none of them taste just like the real thing but one is closer to one brand and the next to the other... how do they designate which is which? I wonder if R J Reynolds will get on this band wagon and ask them to take the Camel and Winston names off.... I can understand them wanting them to leave Marlboro off but Cowboy? really??? That's just petty Phillip Morris must be worried.

What I really don't get is why the big tobacco companies just don't get on board and make their own juices it would create a new revenue stream... *shrug*

I can understand PM not wanting vendors to use their TM name, Marlboro, but this is a little much. I can't believe they didn't claim they own the rights to the color red. Next thing, one will claim they own the rights to the word camel and all pictures thereof. :rolleyes: And we wonder why the US legal system is so bogged down. Its nice to know they have so much money they can squander it on frivolous lawsuits. I see the economy hasn't hurt their bank accounts.

Don't think they can on the red... Winston, Pal Mall and several other brands use red to signify their "full flavor" cigs. It's be interesting to see Phillip Morris and R J Reynolds duke it out over the color red though... lol

They can't claim the Camel that belongs to the OTHER tobacco giant :)

Not any different than HD suing small motorcycle shops for using the word "Hog" or "Hawg" in their names.
A friend that had a shop called "The Hawg Pen" was forced to change it to "The Pig Pen", even then, he got a couple of nasty letters, but his lawyer told him they were empty threats at that point.
I believe this issue has to do with the words/names/images being trademarked specifically as they relate to tobacco or smoking related products. I've seen plenty of BBQ places using Hog and Hawg in their names, and I don't see HD going after them.
Unfortunately, these kind of bully tactics by large corps usually come down to who has the most money to continue the court battles. PM knows that these small operations are running on shoestrings, so they'll just keep filing and re-filing lawsuits until it either runs them out of business, or they buckle under and remove the names and images.
As far as others using similar names or images, don't worry, PM will come for them, too. If/when they get the judgment against Freedom2Vape, most of the others can expect to start seeing letters showing up in ther mailboxes soon after.
