I thought those ideas sounded familiar. I got hooked on her when I was in college and should have been reading my textbooks instead.
It appears that the fine for using a cigarette on an airplane is $2,200. And if they somehow bust you in the bathroom, it's $3,300.
The regulation simply folds e-cigarettes into the definition of "smoking," so the same fine would apply.
Ohh, and remember that e-cigarette user who threw peanuts at a flight attendant after he was told he couldn't use it? The criminal complaint filed against him is on WestLaw, and despite the government believing (wrongly) that the current regulation could cover e-cigarettes, they did not charge him with "smoking" on an airplane.
They may also one day replace the majority traditional smoked tobacco if given the chance... THATS the may be I think scares them most of all!!!!!!

I'm not sure of the exact charge. But it would be the same charge anyone would receive if they pitched a fit on a plane and interfered with/accosted a flight attendant. They don't take that lightly, especially in this post-9/11 world. And just my opinion, but he deserves whatever charge they did give him.
