It appears that the fine for using a cigarette on an airplane is $2,200. And if they somehow bust you in the bathroom, it's $3,300.

The regulation simply folds e-cigarettes into the definition of "smoking," so the same fine would apply.

Ohh, and remember that e-cigarette user who threw peanuts at a flight attendant after he was told he couldn't use it? The criminal complaint filed against him is on WestLaw, and despite the government believing (wrongly) that the current regulation could cover e-cigarettes, they did not charge him with "smoking" on an airplane.

I'm not sure of the exact charge. But it would be the same charge anyone would receive if they pitched a fit on a plane and interfered with/accosted a flight attendant. They don't take that lightly, especially in this post-9/11 world. And just my opinion, but he deserves whatever charge they did give him.

His behavior sounds so bizarre that I have to wonder if he was intoxicated.

i was on a flight a couple weeks ago (don't remember who i felw with...delta maybe?), and while waiting for the "you can now use your ipods and toys and stuff" announcement, i read the little pamphlet in the back of the seat in front of me. i was suprised to see that next to the no smoking portion of the rules there was a side note that said "this includes electronic cigarettes".

Department of Transportation Rule Would Prohibit Use of E-Cigarettes on Airlines

The U.S. Department of Transportation has issued a proposed rule to amend its existing airline smoking rule to explicitly ban the use of electronic cigarettes (“e-cigarettes”) on all aircraft in scheduled passenger interstate, intrastate and foreign air transportation. The smoking of cigarettes has been prohibited on airlines for a number of years, and the proposed rule would treat e-cigarettes the same as tobacco products.

The Department of Transportation indicated that it was taking this action because of the increased promotion of electronic cigarettes and the potential health and passenger comfort concerns that they pose in an aircraft. The proposed rule noted that “[e-cigarettes] are marketed as being permissible in places where cigarette use is prohibited.” The Department of Transportation went so far as to comment: “We see no reason to treat electronic cigarettes any differently than traditional cigarettes.”

The comment period on the proposed rule ends on November 14, 2011. As federal, state and local governments increase their focus on the sale and use of tobacco, the Troutman Sanders Tobacco Team will continue to monitor developments in this area. What I find strange is that there are over 300 comments, but they are not placed inside of the Docket Folder. The Docket Folder only contains 3 items. If you search Regulations.gov on just the Docket ID: DOT-OST-2011-0044, on the tab View by Relevance you see the list of >300 comments. However, there is another Docket ID for a Department of Energy Proposed Rle mixed into this list of comments.

You do not need to cover all of the talking points, if you don't wish to do so.
