Don't know if this has already been posted, but I just received sad news from Azure vaping. Due to the FDA REGULATIONS which took effect on 08/08, Azure vaping is closing their doors. They were one of the first vendors that I ordered from when I started vaping around 5 years ago. They had good eliquids at very cheap prices and very good customer service. Although I haven't ordered from them in a long time, it is so sad to see Rob closing his doors. It has been said time and time again, but now is the time us vapers need to unite and stand our ground before other vendors start closing down. If you enjoy vaping, be a part of CASAA or any other organization that protects our right to vape, and let's all fight this!! If we unite, we can do this!!

Have you Pennsylvanians tried ordered from vendors in other states? If I am not mistaken you are responsible to pay the tax and that is a good way to protest your states unfair taxation in my humble opinion!
I don't know about other Pennsylvanians, but as for this one, I don't plan to order from any vape company in any state. I feel it's Russian roulette if you receive a letter from the department of revenue in Harrisburg charging you with tax evasion. Now that any vape product is now deemed a tobacco product, I feel it would be the same as the old days of ordering ciggrettes online from out of state. Many people have reported being caught. If I'm mistaken on this, I'd love to hear opinions. I truly hope I'm wrong.

So @Jugband does this mean you will not buy any new gear? Will you drive or travel to another state and bring it back? If you do that if I am not mistaken you are also supposed to pay the tax.
I have a dozen Reo's, haven't used another mod in years. I have a ton of BF RDA's, thousands of feet of wire, so much nicotine I honestly lost track of how many litters. I can purchase PG/VG and flavors from non vapeing sites. So I'm pretty good.
As far as going out of state and not paying the tax, I'm certainly not above it. I don't like any of this obviously. I feel for all the PA vape shops that are being forced to close, all new vapors that aren't being given the opportunity I was, smokers who haven't found vapeing yet. This is just a horrible injustice. I haven't given up by any means. We all need to fight, but I'm preparing for the worst.

Technically you are supposed to pay a use tax on online purchases, but no one does and most states do little to collect, at least on small ticket items. It will be interesting to see if Pa goes after their online tobacco tax.


Jeez, I always pay that dang online tax! On most things, it's much less than 40%, and other than vape supplies, I'm a pretty light online shopper. I'm not sure how hard the state willl try to find online vaping sales, but since they're worth more tax dollars than books on Amazon or shoes at Zappos, I wouldn't be surprised if they tried a bit harder to find vaping purchases. I'm also not sure what powers they have to compel online vendors to report sales, but I do know lots of folks who bought cigarettes online got nailed for unpaid taxes. Liens on their houses, that sort of fun thing.

The 40% tax kicked in on 8/1, and so, yes, my last purchases were 7/31. I was oh, so tempted by the Labor Day Sales, but passed, because:

a. I'm not into doing the math on the amazingly obtuse PA-40 tax form

b. I'm expecting a ton of B&M going-out-of-business sales when the floor tax hits 10/1.

It really saddens me that my legislators don't seem to care. I've sent letters to them all, but the replies are pretty much: Thanks for your input. No commitment to help, no comment on floor tax, not even a justification for the legislation. PA is a beautiful state, with lots of cool things to do & see, but golly, we have some sad excuses for legislators.

I didn't know that about online cigarette purchases. That's crazy. Did they look through CC transactions to catch them? What if you used one of those cc/gift cards?

Really, the government should be giving us a tax break for all the money that we will save them on Medicare expenses.

I'm not sure how they track this (transparent government is not really a PA thing) but did you notice this:

"Possession of more than one carton of unmarked cigarettes can result in a $300 fine and imprisonment. Willful evasion of the state's cigarette tax can lead to five years in prison and $15,000 in fines."

This article is from 2009, and now that vaping is "deemed" tobacco, I'm not sure whether that's included in the state cigarette tax rules. If it is (and why the heck not, it's PA!), not declaring and paying the tax could have very serious consequences.

That's nuts! Can you imagine being in prison and being asked "What are you in for man? Ahhh Smoking."
Can you get in trouble if you drive to a neighboring state and buy cigarettes for personal use?
