Scam company trying to steal Boba's Bounty trademark

To whom it may concern at AVE:

You may already be aware of this but just to make sure: The company mentioned in the stickies is attempting to steal the Boba's Bounty trademark. BOBA'S BOUNTY Trademark Application of Alien Vapor Enterprises L.L.C. - Serial Number 85898782 :: Justia Trademarks

You need to dispute this registration, register the Boba's Bounty trademark as your own, and force these scammers to stop using the name once and for all.

Clearly by the number of people getting scammed there is far more than enough demand for Boba's to defend the trademark. If the scammers successfully register the mark, their Boba's will become the legitimate one and they could C&D YOU to stop using the name. That is an offensive thought, please prevent that from happening. It's high time this company were dealt with and IMO they should be sued for damages as well.

They've taken the name we use on our e-liquids and applied it to their own. What they have failed to do thus far is actually recreate the flavor. That is the real trick.

I promise you it hasn't been my winning personality or any marketing trick that makes Boba's Bounty so popular...it's the flavor. Hell, I didn't even name it, customers did.

IF they actually get it trademarked AND they send me the cease and desist letter (they'll have to)...then I'll change the name and let all of you know via our front page. The Boba's Bounty that people love is a flavor...not a name. We only use the name to put a fix on a flavor that doesn't have any better description.

I can't control someone's moral scope or how they practice their ethics. Trying to force someone via litigation is just miring yourself in minutia when you could be succeeding elsewhere.

One thing that strikes me as reprehensible from Alien Vapor is that they feel any sale is a measure of success...it's not. It's a measure of how trusting people are on the internet.

I'll look into changing the name. I should do it sooner than later as it takes some time for new names to propagate through Google searches (around 2-3 months by my estimates)

Let them go to all the trouble and expense of trademarking the name and legal channels of cease & desist....like Ben said, he'll just change the name. It's the flavor and aroma that is the real gem here.

I don't care what you call it...I'll still buy it. As long as I know what to order.....and Ben will tell us.

Actually, as a lurker I can tell you this type of behavior is why Alien vision just received my second order in a week.
This only after my 3rd week of being analogue free.
Heck, four weeks into this vaping craze and now Boba and the Gorilla have got me, hook, line and sinker.

After investing a $150 into a new form factor of medication from here, I do not feel poorer.
I do know that the folks at Alien Vision e-juice have earned a fair return for outstanding product...

I don't think the word "Boba" can be trademarked. It's not like its called "Boba Fett's Bounty", in which case Disney may have had a problem with it.

Well... maybe... but I don't think it would be that big a reach to say make the connection between "Boba's Bounty" and the character though. There really isn't much room for interpretation. I mean, if someone had a juice called "Vader's Wrath" or something, it'd be a reach to try to explain it as something different.

Because you own it, someone is infringing on it, someone has STOLEN your trademark, and your customers are getting scammed. Nothing necessarily stops a company in another country from infringing but it WILL give you the right to C&D any US seller that stocks their juice ... given the juice market's preference for US juices that's huge. You absolutely should litigate at least once (or rather file opposition to the trademark filing, if it's not too late) to seize back or nullify Alien Vapors' trademark before they slap a C&D on YOU.

I can't believe you see no value in protecting this trademark. The whole trademark system is to prevent exactly this happening.
