SE, FDA and Pipe tobacco

This got mentioned in another thread, however I feel it is so pivotal it should have its own.

Pipe Tobacco

I never smoked a pipe so I was completely unaware that propylene glycol was used in some pipe tobaccos as well as in hookah tobacco.

So the basic ingredients for those products is: Tobacco , PG, and flavoring.

All Smoking Everywhere needs to prove is that the nicotine in e-juice is actually an 'essence of tobacco'. Making it a tobacco product that is already on the market, pipe tobacco.

I think at the end of the day, SE will get slammed for false advertising both for mitigating claims they made and also claiming that their product wasn't a tobacco product when in fact it was.

However I think E-cigarettes will win as a whole.

BG, I don't know if you knew this, but PG is also used in cigarettes. As is glycerin.

And as our nic liquid is derived from tobacco, I've been saying this all along - ecigs contain nothing that is not already found in cigarettes, just many fewer ingredients.

SE is saying essentially the same thing - I was going to quote from their memorandum of law, but just went to the link and now access seems to be denied. Anyway, I did read both their complaint and supporting memorandum several times, and they very clearly are arguing along these lines, and that ecigs are meant to be simply cigarette alternatives, as their basis for claiming the lack of FDA jurisdiciton.

Agreed. However, it is more painfully obvious when you compare pipe tobacco and e-juice.

I would just love to see the lawyer hold up a bag of pipe tobacco and a bottle of e-juice and say "chunky" vs "smooth" lol

I would say its more similar to hookah tabacco. Why? Because hookah/argile/water pipe tabacco does not get burned. The charcoal is burned, which is on top of an alluminium foil with holes in it. In turn the Alluminium foil is on top of the tabacco/pg/flavor mix. I know because I used to serve hookahs at a restaurant.
After the tabacco is done you are left with black residue of tabacco which does not smell like its burned. The first time I had an e-cig I thought its exactly like a hookah.
